Been standing 6 hours on a city corner smiling and collecting cash for Veteran Support. It’s Poppy Day in NZ. The Army Reserve were LATE! So we lost about 10% of our take in the first 6 hours. Bloody Reserves. Their Sergeants have to ask them to p-l-e-a-s-e turn up rather than ordering them to be on parade at 0530. The ‘poppies did not get delivered until 0810 at which time a goodly proportion of office workers were already at their desks and inaccessible.

Still there were some positive highlights. Like the pretty Chinese lady who thanked the defences forces for their services pushed $100 through the slot in my bucket and received her 4 cent poppy. Or the business man ( normally not a demographic that gives) who claimed that he didn’t have any cash and he’d come back when he did but I gave him a poppy on trust. 5 minutes later he arrived back and pushed $60 into the bucket.

My back hurts, my feet hurt and I’m weary from having been up since 0515. The mayor didn’t show up but he had a hospital pass so I’ll forgive him. In his stead the Minister of Defence ( Kiwi equivalent of Sec Defence) showed up Ron Mark down at the Central Railway station and we had a long chat before we kicked the collection off. Got myself an invite to talk more to him about the run down in NZ Armoured forces and the alternatives available like IMI’s Iron-Fist active defence for armoured vehicles.

All in all a good day.

Looking forward to a Guiness with the guys at the Claddah Irish Pub this afternoon.

In a nutshell, apparently some (and always unnamed) sources in Trump World say that Michael Cohen may “flip” on Trump because, essentially, he’s terrified of going to prison and getting raped by a Black man.”

Oooookay. Let’s start at square one. Unless Trump asked Cohen to further a CRIMINAL enterprise, all communications between them are covered and protected by the attorney-client privilege. And it is TRUMP who holds the privilege, NOT Cohen. And seriously, Cohen sounds more and more like a walking malpractice suit than someone who furthers a criminal conspiracy. I don’t think the chump has the brains for it. If Eddie Haskell had grown up to be a lawyer, he’d be Cohen.

Second, Cohen would go to Club Fed at Fort Dix, not Leavenworth for God’s sake. I seriously doubt that the “Black” guy who’s doing 7 years for insider trading is going to regard his scuzzy ass with any worries. The worst thing he’ll be dealing with there is the obnoxious Martin Shkreli.

“I then executed the session exactly as I had planned,” Comey noted before going into details of what he claimed he told the president-elect. He wrote that he told him about the now-infamous prostitute pee-pee videotape claims contained in the dossier.

      executed…exactly as I had planned

That’s from Comey’s memo. Molly Hemmingway has the rest and it shows conspiracy…

Russia’s very own ‘blue wave ‘ …will never happen either…….

      —————

Russia’s shipbuilding program for 2011–2020, under which the country plans to build over 100 new warships (Military Paritet, February 7, 2012), is reportedly causing “a very bad feeling” among some Russian naval experts (Topwar.ru, August 10, 2016). They describe the current status of the Russian Navy as a “ceremonial fleet” and have suggested that one third of the shipbuilding program has resulted in little more than a “donut hole” (Nezavisimoe Voennoe Obozrenie, December 22, 2017; March 3, 2018). The ongoing production difficulties appear linked to insufficient naval shipbuilding capacity and a problematic manufacturing process.

Democrats sue over alleged 2016 campaign disruption

The Democratic Party on Friday sued President Donald Trump’s presidential campaign, the Russian government and the Wikileaks group, claiming a broad conspiracy to help Trump win the 2016 election.

The multi-million-dollar lawsuit filed in Manhattan federal court says that “In the Trump campaign, Russia found a willing and active partner in this effort” to mount “a brazen attack on American Democracy.”

i wonder what their internal polling looks like.

i cant wait for discovery on this!

They DNC spent $400 to grab a headline. It would not surprise me if they never even bother to serve anyone with the complaint and just let the 120-day service period expire and voluntarily dismiss the complaint. But today they’ll get some nifty headlines that let everyone know they’re SERIOUS! and to distract from the request by the 12 Republicans in the House for an investigation. Look! Squirrel!

In 10 days everyone will even forget this complaint was filed but their willing partners at CNN and MSNBC will put on their very serious “lawsuit” faces today at least.

If for some reason they actually DO serve the summons and complaint, I personally don’t see how it survives a FRCP 12(B)(6) motion to dismiss for failure to state a claim for which relief can be granted. But holy hell, if it goes to discovery – stock up on the popcorn. My only annoyance is that discovery isn’t filed with the court so I couldn’t use PACER to access it for our enjoyment.

    25. 25 | April 20, 2018 1:29 pm

      @ coldwarrior:

Common misconception. You have to have served the complaint within 120 days or you get hit with a show cause order as to why you have failed to do so. Which means you essentially have to show due dilligence in service of process.

I went to the Southern District to look up the complaint so I have the case no. and will be keeping an eye on it. One look at the defendant line-up tells me they are NOT serious. The parties are: The Russian Federation, the General Staff of the Armed Forces of the Russian Federation, GRU Operative Using the Pseudonym “Guccifer2.0”, Aras Agalarov, Emin Agalarov, Joseph Mifsud, Wikileaks, Julian Assange, Donald J. Trump for President, Inc. (which probably no longer exists), Donald J. Trump Jr., Paul J. Manafort, Jr., Roger J. Stone, Jr., Jared C. Kushner, George Papadopoulos, Richard W. Gates, III and John Does 1-10. (instead of the more generic “DOES”, which is odd).

They’re in for an ass-kicking in discovery. Wikileaks and Assange have maintained from the beginning that the Russians didn’t give them anything. So Julian may just release the name of that Democrat operative I strongly suspect DID give him the emails. And the DNC better hope against hope it wasn’t Seth Rich.

It does. Or there’s a financial filing due and they need to raise money. But Levin pointed out something last nite – the allegations about Trump, et. al., have been one long conga line. Remember that psychiatrist from Yale, the Asian woman? Yeah, and after their shelf life is over, something else pops up. This is just another bead in a conga line.

I wanted to ask you – do they have to file suit against EVERY entity named or can they choose just one – say Roger Stone – without getting hit with a show cause order after the 120 day period?

Oh it’ll get tossed. Almost every motion to dismiss we file these days cites Iqbal and Twombly. And we win a LOT of them.

Iqbal will be familiar to some of you, if only because a certain Special Counsel’s actions had a hand in it: https://www.law.cornell.edu/supct/html/07-1015.ZS.html

      Twombly is here: https://www.law.cornell.edu/supct/html/05-1126.ZO.html

That’s assuming ANYONE in this lawsuit is ever really served. Which I suspect they won’t be.

    39. 39 | April 20, 2018 5:38 pm

      @ eaglesoars:

And I’m so used to the old rules – I forgot the District Courts have shortened the time to 90 days, not 120.

As long as they serve ONE of the named defendants, they won’t be hit with a show cause order that mandates dismissal for want of prosecution. So, let’s say they serve Roger Stone. His ANSWER will be due 20 days from the date he was served (you must serve by hand unless you obtain a Waiver of service, which I seriously doubt any of the defendants will grant).

Where they might be able to buy themselves some more time is the foreign entities, which have to be served in accordance with the Hague Convention for foreign service of process; however, both Ecuador and the Russian Federation are signatories so they already have the mechanism in place, which would facilitate service within those countries.

So what they essentially would have to prove with the unserved parties is why they were unable to perfect service on them within the period prescribed by statute. Not going to be easy to do. I’m going to check back in a week and see if they’ve filed the Service of Summons endorsed on anyone.

But discovery is reciprocal, right? Two way street baby…I read Donna Brazille’s book and even as non-tech as she is, I have enough tech background to go deeper than she was able to – if I had to start anywhere, it was an inside job and Crowdstrike had something to do with it. So if this lasts long enough to actually serve anybody, I’d play hardball and start discovery proceedings against everybody who ever breathed the phrase ‘DNC’.

Lawsuit Claims Money Laundering In Hillary Victory Fund, Stars Implicated

Big name stars who wrote big dollar checks are lawyering up. Steven Spielberg, Calvin Klein, even the CEO of Facebook, Sheryl Sandberg were caught in the net. All could soon be facing charges of making contributions in excess of the Federal Election Commission limits.

      https://conservativedailypost.com/lawsuit-claims-money-laundering-in-hillary-victory-fund-stars-implicated/

Here’s the thing. IIRC, Donna Brazille talks about this in her book and how frustrating it was for her trying to get even things like yard signs because all the money was being controlled by the national group.

      Right there. Black and white.

Good Luck With That: McCabe Plans To File Lawsuits For Defamation, Wrongful Termination

Ex-FBI Deputy Director Andrew McCabe plans to file lawsuits for defamation, wrongful termination and other claims, his lawyer said Friday.

Attorney Michael Bromwich said McCabe’s legal team was still working out when they plan to file the suits, and that they “want these to be solid. We’ll file when we’re ready,” Axios reported.

Bromwich accused McCabe’s opponents, including President Trump, of “continuing slander,” although he did not specify whom the suits would target.

“We’ve never seen anything like this before. It does damage not only to Andy McCabe individually but also to the FBI as an institution,” he said.

    63. 64 | April 20, 2018 7:58 pm

      @ lobo91:

Frankly, I think this is McCabe trying to counter allegations that they LIED about the nature of his GoFundMe crowdfunding request. GFM does not permit you to crowdfund to pay for a criminal DEFENSE. But if you wanted to FILE a lawsuit, hell yeah, press PayPal. I’m willing to bet this is McCabe’s trying to fight back on the allegations.

He’s going to have a hard time proving defamation with a criminal count being sought against him.

Yeppers: A New York Times reporter contemplated freezing her eggs for Hillary Clinton

When we saw this email header from a news headline popped up on our Twitterfeed, we had to see for ourselves. Did a New York Times reporter really base freezing her eggs on Hillary Clinton’s schedule? The answer is quite remarkable.

New York Times reporter Amy Chozick was picked to cover Hillary Clinton’s Presidential campaign and thought about freezing her eggs until after the election. Her recollection of events leading up to Clinton losing the election is fascinating in itself.

      The excerpt from nytimes.com:

Robby Mook, the drained and deflated campaign manager, told his boss she was going to lose. She didn’t seem all that surprised.

“I knew it. I knew this would happen to me,” she said, now within a couple of inches of Mr. Mook’s ashen face. “They were never going to let me be president.”

In July 2013, Jill Abramson, the former executive editor of The New York Times, put me on the “Hillary beat” ahead of the 2016 election. It was 649 days before Mrs. Clinton would announce she was running for president again, 1,226 days before she would lose to Mr. Trump.

Every major life decision in my 20s and 30s — when to get married, where to buy an apartment, whether to freeze my eggs until after the election — had revolved around a single looming question: What about Hillary Clinton?

Actually looking at the BIG / LONG picture it does. Solar activity or lack thereof does drive weather to an extent. There are a number of different solar cycle periods embedded into the Earth’s underlying climatology at much longer time scales than mere weather. Their reinforcement or negation drive other complex longer or shorter cycles. Mankind on the other hand comparably does diddly-squat by comparison, even with all of the forcing nonsense put about by some climatology pan-handlers looking for grant funding. Even NOAA has been caught ‘adjusting data’ on occasion.

Interesting comments on Istapundit’s open thread:

      From ursa5000:Patagonia:

I was waiting in line at the front desk, for my turn to check out yesterday morning. Lots of tours, some big groups. I’ve been waiting ten minutes.

A Chinese tourist elbows me HARD, and cuts in front of me. I was surprised, instantly angry, and I had a sore biceps from the elbow. I started to shove back, and this 40’s ish Chinese fellow, well dressed, and in a perfect New England accent, tells me to” Eff off you American whor$”.
I was thinking about how to best break his jaw, when the another hotel staffer grabs my arm, and says, “ You don’t want to spend the night in an Argentinian jail cell.”

“ The Chinese are friends with the local police, and are buying up property all over Patagonia, plus they hate Americans, REALLY hate Americans. It’s a deep hatred and they pull this crap every day so the local police can shake down American tourists.”

The Chinese guy starts smiling, and says, “Effing American, all of you will all work for us soon enough”

I mimed taking a .45 out of its holster, racked the slide, pointed my finger at his forehead and leaned forward until it touched, and softly said,” Bang.”

      He stopped smiling…..

Mrs. MF brought her in the house & she’s in the living room in a cage until she’s checked for any nasty things like Feline leukemia or AIDS, rabies, etc. She’s very sweet and looks to be about a year old. We’re hoping she’s not pregnant.

Orin Hatch is retiring, so Romney relocates to Utah to replace him. Slam dunk right?
Not so fast, Mittens finished second in the vote at the Utah Republican Convention and faces runoff.
Trump carried Utah even after Romney’s hit job. There could be a message there.

      😆

the japanese said and did the same shit in the 80’s and lost.
