Looks like Judge K will be confirmed and the Dems just got slapped down

I am starting to see vertebrate-like behavior from these carbon-based life forms in the GOP.

I hadn’t paid any attention to this. Among the people in Christine Ford’s life going public with their support for her, the only family members are on her husband’s side.

    4) Her own immediate family doesn’t appear to be backing her up, either. Her mother, father and two siblings are all conspicuously absent from a letter of support released by a dozen relatives, mostly on her husband’s side of the family.

The letter attests to her honesty and integrity. “Why didn’t her parents and brothers sign the letter?” a congressional source familiar with the investigation wondered.

I haven’t been paying much attention to this Ford circus, but if I understand it the vote happens on Friday? How convenient. Mr. K for the win.

The dems had their demagoguery and Ford her 15 minutes o’ fame and the man is still standing, so now they have to put up or shut up. Looking forward when Ginsburg departs and PDT gets to pick another SCJ. The fits of impotent rage will be epic.

the president began his speech noting that, “In less than two years, my administration has accomplished more than almost any administration in the history of our country.”

The bureaucrats shifting upon their glutei maximi upon the plush receptacles provided by the custodians of the United Nations may have found the president’s frank statement risible. But their hilarity detracts not one iota from the truth of his observation.

Ford is submitting ‘corroborating stmts’ from 4 people who claimed she told them about the ‘assault’

“In another declaration, Keith Koegler said Ford revealed the alleged assault to him in 2016, when the two parents were watching their children play in a public place and discussing the “light” sentencing of Stanford University student Brock Turner.”

On that day, Koegler said Ford revealed to him in an email that the person who had assaulted her in high school was President Donald Trump’s “favorite for SCOTUS.”

Kavanaugh wasn’t added to Trump’s SCOTUS list until Nov 2017

eagles – as I suspected, the overnighters in the media got to the databases but here’s a profile on her, from the New York Times, no less:

    https://www.nytimes.com/2018/09/26/us/rachel-mitchell-bio-facts.html

She’s a CAREER prosecutor, which is pretty amazing; a lot of attorneys work in the DA’s office to get experience to hang out their shingle as a criminal defense attorney later. To stick with it for almost 30 years at a lower rate of pay than the private sector tends to indicate a commitment to seeing justice done in my book.

Judging from her bar admission date and employment history from the Arizona State Bar website, she went right from her admission into the Maricopa County DA’s office. She seems to be very highly regarded for her work there and has even been recommended for a judicial appointment.

Of course, they can’t help but SNEER that Maricopa is the same county as Joe Arpaio. I would point out to these snots that Arpaio, for all his faults, was committed to punishing criminals, not giving them chunky peanut butter and weight rooms. A dickhead on Twitter said “she’s with with Joe Arpaio office in Arizona” which is pathetically stupid, but it’s what I’ve come to expect.

At this point, I can’t answer these people anymore. The sounds coming out of my grand-daughter’s mouth make more sense.

Oh and by the way, Kavanaugh DID produce his calendars. I’ve examined a lot of evidence in my time. These look like the real deal.

I was clearing up the morning papers Hubby had been reading and there was a headline on pg A1 below the fold I thought was odd. Something about tariffs hitting home buyers. ??? Turned it over and it’s not a paper we subscribe to.

By the way, has anyone noticed that on Monday, Judge Kavanaugh made the statement that he was a virgin in high school and for many years after. That’s a pretty “ballsy” (no pun intended) statement to make. All you need is just ONE person to come forward and say they had sex with him in high school. Or even college for that matter.

    And no one has.

She is apparently a few years older, she would have been 20 or so and she’s a graduate of a public high school in Gaithersburg MD. But she would not have been in high school when she attended the parties because she would have already graduated.

How did she meet this crowd? There’s a ‘mutual acquaintance’ somewhere.

After multiple parties where she witnessed this ‘spiked drink/rape train’ behavior (she kept attending them), (1) even tho she says she avoided ‘the punch’ (2) and observing it was the ‘shy’ girls who were targeted – she says she was drugged and raped at one of the parties. But she doesn’t name the rapist(s).

She says she also attended such a party during ‘beach week’ at Ocean City. There was a ‘beach week’ on Kavanaugh’s calendar and I think it says ‘Timmy’s party’. Find out if that was in Ocean City and who the hell is Timmy.

have at it, I’ve got deadlines

So, Judiciary Committee Democrats and Schmucky Schumer are demanding Kavanaugh withdraw. Why? You have a hearing scheduled for tomorrow. Don’t you want to hear from everyone?

Now it’s clear. As we suspected all along. The plan was to up the ante on the allegations until Kavanaugh caved rather than put his family through this. Except he didn’t. And now Ford is expected to show up tomorrow and testify. This is desperation on their part. No doubt they PROMISED her it would never come to her being put under oath under penalty of perjury. She could care less about facing Kavanaugh in a room, or what media is present, or who does the questioning. It was all about not being put under oath.

Hence the so-called declarations that she submitted. Except they corroborate nothing other than the fact that she started talking about the incident after 2012. They have refused to turn over the therapist’s notes or the polygraph results to Kavanaugh’s attorney. And there are serious factual problems with these affidavits vis-a-vis what was told by Ford to them.

The only people who can corroborate her story have refused to do so.

  33. 34 | September 26, 2018 3:24 pm

Uh oh….looks like Avenutti may have exposed his client to legal jeopardy.

It turns out July Swetnick graduated in 1980 – this would have made her a college sophomore when she attended the “gang rape” parties. With high schoolers. Let that sink in. And according to her, she attended something like 10 of them. AND. DID. NOTHING. TO. STOP. IT.

She was over 18. She was a legal adult. As such, she can be charged with several offenses, not the least of which would be her facilitating the rape of a minor, not to mention contributing to the delinquency. And last time I checked, Maryland had removed the Statute of Limitations on crimes of sexual assault.

Oh, and Avenutti will not let her be interviewed by the New York Times. I also note with interest that her “declaration” was executed YESTERDAY. Not over the weekend or Monday. Yesterday. And unless it is submitted to a body with judicial authority, it carries no perjury jeopardy. Did he submit to the Senate Judiciary Committee? Not as far as I know. She executed this affidavit AFTER Kavanaugh’s calendars were released.

Supposedly she has government clearances. So she KNEW that when Kavanaugh was nominated, there would be a vetting process and background examination by the FBI. Why, if she possessed this information, did she not voluntarily advise the FBI regarding this knowledge and allow them to then conduct an investigation, and which would have had the benefit of getting these so-called “facts” out there but would not have required that her name be made public in the process.

So far today, not a single individual to my knowledge has stepped forward to verify her story.

NBC has gone public with a TOTALLY anonymous allegation. BUT – it’s from 1998, so it moves the narrative forward.

According to an anonymous complaint sent to Republican Sen. Cory Gardner of Colorado, Kavanaugh physically assaulted a woman he socialized with in the Washington, D.C., area in 1998 while he was inebriated.

The sender of the complaint described an evening involving her own daughter, Kavanaugh and several friends in 1998.

“When they left the bar (under the influence of alcohol) they were all shocked when Brett Kavanaugh, shoved her friend up against the wall very aggressively and sexually.”

“There were at least four witnesses including my daughter.” The writer of the letter provided no names but said the alleged victim was still traumatized and had decided to remain anonymous herself.

On nomination and before hearings it should be stated publicly.

NOW do you begin to understand why I think women who make false accusations should face jail time?

I agree, I posted a half thought out comment on DoD a couple of days ago. Still not formulated it fully but…

In a criminal trial a lawyer representing the defendant can “omit” facts, that is OK by me. They are representing a defendant.

In a civil lawsuit, or not even a lawsuit but a lawyer representing an accuser as spokesperson is found to defame a person not only is the client he/she represents is liable to be sued but the lawyer themselves representing the client is also liable to be sued.

    Does that make sense?

It does, with some latitude for ‘reasonable knowledge/intent’, etc.

We have a SCOTUS ruling here commonly referred to as ‘Sullivan’ that allows well-known people to be defamed w/o consequence. You have to show deliberate malice to win a case if you’re someone like Sarah Palin, who sued the NYT. Barbarian can explain it to you.

Here’s the background on the domestic violence charge file against her.

    https://www.politico.com/story/2018/09/26/ex-boyfriend-filed-restraining-order-against-kavanaugh-accuser-845348

According to Vinneccy, Swetnick threatened him after they broke up and even after he got married to his current wife and had a child.

I do not have a dog in this fight so to speak, but as you can see I am not happy with what is happening currently.

In a civil case if an attorney “speaks on behalf of his/her client” then through power of attorney they are equally liable.

    In my mind.

Here, if the prosecution withholds exculpatory evidence from the defense, a conviction can be tossed. BUT – a big problem I have w/the legal system here – is that prosecutors almost NEVER face consequences.

Do you know that Mueller KNOWINGLY sent 4 innocent men to prison, 2 of whom died there, in order to protect an FBI confidential source?

And don’t get me started on Andrew Weisman, who took out an entire company, Arthur Anderson. All the convictions were eventually overturned, but the damage was done. The company had gone out of business, THOUSANDS of people out of work – and Mueller hired him for the Russia collusion probe. He is still practicing law.

    @ eaglesoars:

ok, I found her stmt over at zip’s there’s nothing there about her email being hacked.

There’s a problem with it tho.

She describes going to the house from a day swimming at the club, going upstairs to the bathroom, getting shoved into the bedroom, the assault, running back into the bathroom, then, when she heard the boys go back downstairs, running out of the bathroom, down the stairs, thru the living room and directly out the door.

    Where’s her purse?

there is, the dems under feinstein broke that rule. this evidence should have been brought up months ago, the thing is, it would have fallen apart by vote time, so it was brought up very late after the ‘hold your peace’ deadline of the committee.

the rules mean nothing to these people. they are in their death throws. the only thing that can save them now is to make judge K walk away. this will piss off enough gop voters who WILL stay home and then the dems will win the mid terms.

at that point, they have 1/3rd of the government back and will cause serious problems.

this is all a last ditched effort to save the mid-terms.

hudge K has to be voted in or this will happen to every appointee. every one of them.

these accusations are a giant load of shit. and it is time to make the dems eat some shit.

    don’t surrender to the enemy.

Christine didn’t have a purse. She had a beach bag. If she spent the day at the club pool, she had a very large beach bag. It was either in the car that transported them from the club to the house, or it was in the house with her.

Wallet, keys, MAKEUP, hairbrush, sunscreen, sunglasses, towel, flipflops –

I find highly unlikely she went home w/o it. Where was it/how did she retrieve it?

Kavanaugh wasn’t added to Trump’s SCOTUS list until Nov 2017

One other obvious bit missed here. If Kavenaugh was Trump’s favorite pick, why did he pick Neil Gorsuch first? He wasn’t absolutely sure he’d get more than one nominee, so you’d think the favorite would have been the first one.

Nope, that sounds just like the Republicans after they, with a majority, cave to the democrats, “This wasn’t the hill to die on, but we’re really gonna take it to them next time”. Except next time isn’t the hill to die on either, and so on ad infinitum.

You do not come out ahead by caving to demagogues. You stop this crap by pushing through and ignoring it. Or you never win again.

More: Judiciary Committee sent letter today to Ford’s attnys requesting 1) audio/visual recordings taken during Fords’s polygraph; and 2) charts/data used in drawing polygraph conclusions. Ford’s attnys just now refused to supply, saying such material not “important.” Really?

There were only 2 questions asked during the polygraph: 1) is your statement true? 2) did you make anything up?

    @ eaglesoars:

A nobody? Not to me. I’m President of your fan club.

There’s something up at Twitter and I cannot put my finger on where it’s coming from. It involves a “surprise” for Ford at the hearing tomorrow that is going to blow her claims out of the water. I’ve heard something about an email in which she states to someone that the whole claim is “bullshit” (sorry CW). And supposedly now Ford is claiming her email was hacked. I drift in and out of Twitter once I leave the office, so I can’t find the genesis of all this. Hoping Twitchy may have something later or soon.

Oh, and apparently one of the ex-boyfriends of Julie the Gang-Rape Queen took out a restraining order on her because he said she threatened his wife, his family and his infant son. He said she is not to be believed. Looks also like she filed a sexual harassment suit against her former employer, New York Life, and they gave her a settlement* Her attorney in that action? Deborah KATZ.

Someone on Twitter said it better than me: “It sounds like maybe that 4Chan story is true and Deb let Avenutti borrow her rolodex.”

    * A lot of these lawsuits for sexual harassment, even if sketchy on the facts, are settled. Employers know that juries tend to be sympathetic to the “victim” and make large awards with punitive damages. Also the costs of litigating one of these cases from Answer to Judgment, can run close to a million bucks, even for a relatively minor matter. Many companies are willing to write a check for $100,000, with a settlement agreement admitting no liability, and an agreement not to disclose.

I’ve got everything covered upthread except for the ‘surprise’ tomorrow and her supposed claim that it’s all bullshit.

Her statement to the committee is here but I couldn’t find where she said her email was hacked

    https://www.theatlantic.com/politics/archive/2018/09/read-christine-blasey-fords-opening-statement-brett-kavanaugh-supreme-court/571366/

I read it. In my mind I put myself in her description of what happened and I realized there was a piece missing. See my #65 and #68 and tell me what you think

Now 2 other men are claiming THEY were the people who had the ‘encounter’ with Ford. Could that be the surprise?

  82. 84 | September 26, 2018 11:29 pm

    @ eaglesoars:

Do we know if he was a polygraph examiner for the FBI?

These questions are deliberately vague and I understand she was asked them ahead time. I could show no deception on those two questions. We don’t even know if she was answering questions regarding the original handwritten statement or the one she edited.

The photo of her shows her hooked up to a blood pressure monitor – I don’t see any wires leading to the chest hookup or the sensors on the fingers. In that photo I would think the only question she could be asked is “did you know you’re at about 120 over 80 right now?

  83. 85 | September 26, 2018 11:38 pm

    @ eaglesoars:

Now that would be good. Some have speculated it was at HER house.

    @ eaglesoars:

I should never think I come her and break a story. Your analysis is excellent.

On a quick note, watching a rerun of Grace v. Abrams discussing Scott Peterson. Mark Geragos is on basically saying his representation of Peterson was pretty much malpractice. I’ve had a case where Geragos represented the plaintiff. He’s such a hack. I thought he was the dumbest lawyer in America until Avenutti came along.

Time to go cuddle my little Noodle. See you all tomorrow. Should be a 3-ring circus.
