    My baby sister works for Microsoft. We had a case where our client sued MS and when she heard about it and saw the litigation hold memo in her department, she immediately called me. “THIS IS YOU!” Rather accusatory. I said “hey, I don’t pick the clients.”

    It settled early, thank goodness, but I had to attend the announcement press conference where Paul Allen was appearing. He was so funny during the announcement and the Q and A.

    On another note, I don’t know that it was necessary for Trump to call Stormy Daniels “Horseface” in a Tweet. I get that he’s mad, but frankly, I was really, really, hoping he’d take the high road on this one. Of course, Avenutti didn’t even give him a chance. Filed an immediate notice of appeal. And of course, wants GoFundMe to pay for the legal fees for his appeal.

    Well, she did fire the first show across the bow. First of all, she’s an extortionist. Pay me money or I’ll expose our sleeping together. So’s she’s given $100,000 and an NDA, which she signs. Comes back a year later with the creepy porn lawyer in tow, who in his effort to make himself a national figure and involve himself in the Trump maelstrom, has given her the horrendous advice to ignore the NDA she signed and go public – this way she’ll “take down Trump” and he’ll be famous.

    Violating an NDA can cost you a fortune. Because not only do you have to return the money you received in consideration of signing in, you can be assessed damages for violating it. And Avenutti’s excuse of “only her signature is on it.” Truthfully, that’s the only signature that matters. Was she paid? Yes. Did she sign it? Yes. Did she ever communicate her concern about not being in possession of a fully executed agreement? No. Did Avenutti as her lawyer? That’s malpractice.

    My guess is the suit to throw out the NDA will also go the way of the defamation suit. Out on summary judgment. And there will be even MORE attorneys’ fees and costs to pay.

    Sessions specifically singled out New York district court judge Jesse M. Furman, who ruled that Commerce Secretary Wilbur Ross could be questioned in an ongoing lawsuit concerning the legality of the Trump administration’s decision to add a citizenship question to the 2020 census.

    Furman’s decision, Sessions said, contradicts longstanding statutory provisions that protect certain executive branch discussions from disclosure, in order to encourage free and open deliberations by executive branch officials. The plaintiffs in the lawsuit, including several liberal states, are arguing in part that the White House added the citizenship question for political reasons.

    The judge wants “to hold a trial over the inner workings of a Cabinet secretary’s mind,” and inappropriately allow inquiry into the motivations for the Trump administration’s decisions, Sessions said.

    I was just going to post that salvo by Sessions. I think now that Kavanaugh is in place the reckoning begins. Even though Trump complained about Sessions, that was a tactic. Trump has been saving Sessions for an onslaught before the elections.

    I’ve read that Sessions is an honest man. Dr. Dave Janda said that the circus and stalling techniques with Christine Ford held up Trump’s plans to de-classify documents and bring out the cockroaches. We will see. I agree with you that this is an important move.

    Oh, it will be interesting, but this particular case started even before Stephens resigned. It has to do with the cycle of the way the court works. It went on their docket before then.

    Looks like the walls ARE starting to close in. Trump said he’d find the leakers. And he is. Mueller’s postponing his report until AFTER the mid-terms. Which would tell me he’s got nothing. Because if he DID, he’d find a way to leak it and the Democrats could run on “and we won’t let him get away with it”.

    I’m pretty sure this means the reporter is screwed. It’s one thing to passively receive leaked gov’t docs, it’s another to actively direct the leaker to the docs you want..

    But the First Amendment does not protect all speech. Although the president can launch verbal tirades against the press, he cannot use the powers of his office to suppress or punish speech he doesn’t like. When President Trump proposes government retribution against news outlets and reporters, his statements cross the line. Worse still, in several cases it appears that the bureaucracy he controls has acted on his demands, making other threats he issues to use his governmental powers more credible. Using the force of the presidency to punish or suppress legally protected speech strikes at the heart of the First Amendment, contravening the Constitution. Presidents are free to mock, needle, evade and even demean the press, but not to use the power of government to stifle it.

    Except Trump has never done anything to stifle them. Nada. Zip.
