    Those who most require an evaluation are the least likely to submit to one. That is the reason why in all 50 states we have not only the legal authority, but often the legal obligation, to contain someone even against their will when it’s an emergency.

    So in an emergency, neither consent nor confidentiality requirements hold. Safety comes first. What we do in the case of danger is we contain the person, we remove them from access to weapons, and we do an urgent evaluation.

    This is what we have been calling for with the president based on basic medical standards of care.

    Surprisingly, many lawyer groups have actually volunteered, on their own, to file for a court paper to ensure that the security staff will cooperate with us. But we have declined, since this will really look like a coup, and while we are trying to prevent violence, we don’t wish to incite it through, say, an insurrection.

    My new place on the beach starred on the front page of the NZ Herald yesterday. Massive storm here right at the time a ‘king tide’ was running. The ocean is now a LOT closer!

    We’re fine as there is a 5 metre hill on which the house sits above the beach. The road in front is now gone and the guys are bust laying new roadway already. The picnic table just on the rise, down by the beach is now somewhere offshore and has become a reef for the fish!

    The veggie garden needs a little work but we’d eaten most of the produce it grew over Christmas so it’s all good.

    Hmmmm You learn something new everyday.

    Almost High Explosives and especially Plastic explosives are not reactive to heat or shock and need initiation to explode.

    Hell we used to use a nub of PE4 as fuel on which to boil water for a cup of tea !

    So I guess burning out explosives in a vest is a good idea.

    My only worry would be that the heat might set off the detonator and that would not be good whilst there was PE4 still present.

    Smacks of desperation. Personal anecdote: 20+ years ago, there was a guy where I worked who was let go for substandard performance (90’s defense layoffs, so the bar for layoff was set pretty low). I had known him, in passing for years and we would greet each other in the hallway. During the depositions, my name was included and I got called in to talk to the company lawyers. When they learned that my depth of interaction was basically seeing him and saying, “Hey Joe, how are things going?”, they just rolled their eyes, wrote it up and I never heard from them again.

    I’m thinking the same is going to come from this.

    That Golden Globes thing pisses me off. Those harridans have ruined the Little Black Dress for us Deplorables for at least a decade.

    I didn’t watch it. Lectures by Hollywood types don’t perk my coffee.
    But we did see “the Darkest Hour” I highly recommend it.

There are a couple people on twitter besides CTH who don’t have blogs but are doing yeoman’s work in investigating this stuff. ‘Katica’ is one, etc. The stuff you don’t hear ANYWHERE could fill a football stadium, but they’ve got it all archived. There is now an actual profession – something like ‘digital researcher’ – you can train for – and these people are relentless. I have no idea what they do for ‘real jobs’.

    Especially in the case of Madoff – Harry Markopolous told the SEC over and over again that there was NO WAY Madoff could have pulled those numbers off and they refused to listen. His book is excellent, by the way.

    I am so pissed its not even funny. I bought stock in a company called EMXC for $0.01 per share. 10,000 shares. The company floundered around for years. Then was sold off as a shell to a Chinese marketing firm, its now trading at…. $55.10 per share.

    When I demanded to know where my shares went from Scottrade, I was told, basically, you didn’t pay enough for those shares, so we confiscated them.

    The SEC told me they would ask Scottrade if they did anything illegal, but that if Scottrade denied, oh well, there is nothing the SEC can do about it.

    All because I didn’t pay enough for those shares. Some asshole criminal broker at Scottrade saw a chance to make half a million dollars at my expense and took it.

    I have NEVER heard that a brokerage could confiscate your stock because “you didn’t pay enough” for it. There have been plenty of tales of penny stocks actually taking off.

    Have you gotten in touch with Scottrade’s Legal Department? By law, Scottrade must provide verification of ANY movement, sale, purchase, etc. of your stock and therefore you are most certainly entitled to view this. If you have not already done so, I would send them a detailed letter, advising them of the circumstances of this particular transaction.

    I am very much inclined to agree with your assessment of what happened. Frankly, I doubt that many people keep up with their “penny stocks” – in many cases I imagine that they forget all about them, especially if there is no movement in it at any time and selling would not result in a profit – and especially when a minimal investment amount is involved. Therefore, when the acquisition took place, a deceitful broker figured no one would notice and manuvered the record to put to the stock in his name. I also imagine that said unscrupulous broker found out that you indeed HAD been paying attention, he is probably not in a position to cover the $551,000 in monies you are owed.

    I think this would be worth fighting in court. The scandal that ensnared Wells Fargo 18 months ago started, I believe, when ONE bank customer noticed that there were accounts in their name they had never opened.
