These would be laughable if they had been posted by 17-year-old high school students who had received little to no instruction in the precepts of the Constitution; but they were written by GROWN-UPS.  Not only that, grownups that are on broadcast news.  I’ve never seen the job application for NBC News and it’s low-IQ cable edition, but it would not surprise me in the least if the question “Do you understand the fundamentals of the Constitution and the rule of law?  If you answered ‘yes’ to this question, please turn in your application and apply for a job at Fox News and/or Rush Limbaugh.”

I’m not going to insult my reading audience with the explanation of Republicanism, tyranny of the majority and the true intent of the Senate and its makeup; to do so would irritating to you and anyone with a functioning neocortex that may be passing by (because this week I AM going to remember to link this to my Twitter account).  In truth, though, I could NEVER figure out how the requisite 3/4ths of the States were somehow convinced to give up the power to appoint their Senators and went ahead and passed the 17th Amendment.  Dumb.  Really dumb.  If you wanted Senators to be directly elected from your state, you had the option to do so.  But you had to go ruin it for the rest of us.

While there is no real danger of the Senate make-up or the Electoral College going the way of the Dodo, it’s important to see what would happen if these rampant crazies got their way.

Ladies and Gentlemen, I give you California.  Land of the oppressively taxed and the perpetually outraged.

California, like most states, has a bicameral legislature – an Assembly and a Senate.  Both are based on population.  Which of course, begs the question – WHY have two houses, if the population is represented in like manner in both of them?  My guess would be it’s a big state and a lot of people want jobs in government, with government benefits, government payments and per diem.  Personally, I think the legislators in California are in office because they couldn’t get a high enough score on the civil service exam to work for the Department of Motor Vehicles.  It’s worth noting that the voters of California, back when sanity prevailed, put an initiative on the ballot that created term limits.  It’s also worth noting that when those in real power in the legislature are approaching their expiration date, they put on the ballot a referendum that changes the parameters for term limits – with of course a convenient clause that resets the clock for anyone currently in office.  And it always goes down in defeat.

California has 58 counties, including the largest county in the United States – San Bernardino (to give you an idea, if you drive across the widest part, it would be roughly the equivalent of me leaving my office in Oakland, California and showing up at dorian’s front door in the Southland).  The smallest county is San Francisco, comprised ONLY of the City itself.  The intriguing thing is that once you get past the coastal areas, the state goes from light red to vivid red to the Nevada and Arizona borders.  Blue and Red counties in and of themselves are almost evenly divided; yet, up until this last election, the Sacramento legislature enjoyed an almost supermajority which allowed them to pass an exclusively leftist, socialist agenda that apparently is just fine with the blue counties.  Red counties might as well stay home on election day, except we care a great deal about sending Republicans to Congress.

To illustrate the even greater disparity in representation, consider this – the greater Los Angeles area sends almost half the Senate representation to Sacramento; the entirety of California’s Central Valley, representing easily 25% of California’s land mass – sends only 1.  Yeah, nothing wrong there, and I’m sure the interests of the Real Housewives of Beverly Hills and Orange County coincide nicely with their counterparts in Visalia.

Democrats always complain about our governmental checks and balances when they’re out of power.  But nothing is more annoying than their apparent sudden realization that representation in the Senate is fair to every state.  Well, okay, got it.  But maybe they’re on to something.  After all, every state isn’t equal.  So I suggest that if we’re going to change the Senate, and since at least the original concept of the Senate was the for the representation of the individual states in the Federal system, AND since the population as a whole is already voiced in the House, why not make Senate representation based on LAND MASS?  After all, shouldn’t size count?  I can seen their faces now…..

….the minute they realize that the States of Sarah Palin and Ted Cruz are the new New York and California…..

    Barbarian, I stopped by to post this for you, I think you’ll love it. It’s a 1st amendment/civil rights case in Cali. A guy who owns a farm and puts on all sorts of re-enactments of events in American history is suing not just the school board but the board members individually. They looked at his social media posts, decided he was a conservative and cut off visits by the schools, thereby costing him beaucoup $$$ – because they didn’t like the content of his speech.

    Discovery is going to be glorious.

    Today, that is an apt question. There really isn’t much point to having two houses at the state level.

    When the system was created, however, there was a reason for it. The state Senate was apportioned similarly to the way the US Senate is, only using counties. Each county had one Senator, and the idea was that it kept the densely-populated urban areas from outvoting the rest of the state. Made perfect sense.

    Along came the Warren Court and a case called Reynolds v. Sims.

    Reynolds v. Sims, 377 U.S. 533 (1964), was a United States Supreme Court case that ruled that unlike in the election of the United States Senate, in the election of any chamber of a state legislature the electoral districts must be roughly equal in population. The case was brought on behalf of voters in Alabama by M.O. Sims, a taxpayer in Birmingham, Alabama, but affected both northern and southern states that had similarly failed to reapportion their legislatures in keeping with changes in state population after its application in five companion cases in Colorado, New York, Maryland, Virginia, and Delaware.

    And that is how California got as screwed up as it is today, to a large degree.

    No judge assignment yet, I see, and it’s in Los Angeles. Oooeee, this is First Amendment violation at its finest. They should have a judge assignment sometime Monday – probably a Magistrate at first, which is common practice. If anyone declines, they’ll get a district court judge assigned.

    Don’t know the law firm – I’ll check them out on Monday. Be interesting to see if the School District farms it out or requests County Counsel. Probably will farm it out.

    I’ll stick this in my PACER alerts. If something gets filed I’ll get a head’s up.

    Hey, Avenutti – how’s his record before the Supreme Court?
    Oh, and this isn’t a liberal policy decision, dumbsh*t, where they are making a statement for social justice. This is an appeal from a motion to dismiss. I’ve had 8 motions to dismiss get appealed at the 9th Circuit in the last 15 years. They upheld all but ONE of them. The “one” was a class action that they thought was dismissed prematurely and thought discovery should have proceeded.

    Oh, and Trump just appointed three conservatives justices to the 9th, Avenutti. Replaced three LIBERALS. And the hot bench three is a luck of the draw.
