ABC27 learned the health secretary’s mother recently vacated a personal care home in the Midstate.

“My mother requested, and my sister and I as her children complied to move her to another location during the Covid-19 outbreak,” Levine said. “My mother is 95 years old. She is very intelligent and more than competent to make her own decisions.”

  38. 39 | May 13, 2020 9:34 am

    @ RIX:

CA-25 is a pretty Republican district. They’re big on saying that Hillary won by 7% in 2016, but you need to remember something about California. There was NO ONE who believed Trump would win the state, and let’s face it, there was not a lot of faith in some quarters that he’d keep his promises. A lot of Californians did not vote for Trump in 2016 simply because they thought it was a waste of time and effort.

It will be different in November. Trump will take district 25; you heard it here first.

The fact that Sullivan quoted BERMAN, of all people, in his Minute Order is ridiculous. She should have a complaint filed against her (if it hasn’t been done so already) and this judge quotes her? She’s a disgrace to the bench for permitting that juror to serve and not to go after her when her bias was revealed. But then, so is Sullivan for this.

I’d like to see a letter signed by 200 sitting district court judges decrying this move by Sullivan.

    uh oh.

(Washington, DC) – Judicial Watch announced today that it filed a Freedom of Information Act (FOIA) lawsuit on behalf of the Daily Caller News Foundation against the U.S. Department of Health & Human Services (HHS) for communications and other records of National Institute of Allergies and Infectious Diseases Director Anthony Fauci and Deputy Director H. Clifford Lane with and about the World Health Organization (WHO) concerning the novel coronavirus (Daily Caller News Foundation v. U.S. Department Justice (No. 1:20-cv-01149)).

The suit was filed after HHS failed to respond to an April 1, 2020, FOIA request seeking:

I’ve seen a lot of speculation/conspiracy stuff re: Fauci/Gates/vaccinations, etc. that I’ve filed in the ‘agnostic’ bin. It’s staying there for the time being, but keep an eye on this. Judicial Watch doesn’t file FOIAs out of simple curiousity, they’ve got something.

    @ eaglesoars:

It’s tricky as to which orders can be appealed – I would think you could challenge on the grounds that allowing amicus briefs, which are not permissable in criminal cases (although extremely RARE exceptions HAVE been made and ONLY on behalf of the defendant from what I’ve seen) have no place in this proceeding since both sides are endeavoring to achieve the same outcome. But the appellate court could just say to her “you have an avenue if he fails to dismiss and that’s to appeal.”

Los Angeles County, California, was found to have about 1.5 million more registered voters on its voter rolls than eligible voting-age citizens. About 348 counties in the U.S. have more registered voters on their voter rolls than even possible.

Likewise, California has previously had a voter registration rate of over 100 percent, indicating more registered voters on voter rolls than those eligible to vote in the state.

Even stranger, Sullivan has just DENIED the attempt to file the first amici brief, but *also* denied @SidneyPowell1 ’s well argued motion that even allowing amici is wrong. He’s punted

Most likely interpretation is he’s threading the needle of not wanting to rule on Powell’s motion to strike / block amici, by claiming he hasn’t entered a scheduling order yet

Then when Sullivan does enter that scheduling order, he’ll allow the watergate amicus brief, *without* having to rule on Powell’s motion first

Because he knows Powell’s motion quotes his own words back at him – that the Flynn criminal case docket is not the right place for amici,

    @ eaglesoars:

And even in civil cases, amicus briefs are more than highly rare – they are customarily filed in an appeal to debate an issue of law. If you want to butt into a civil action, you file a motion to intervene and a complaint in intervention.

FANTASTIC piece at Red State. Sullivan made a reversible error in accepting Flynn’s guilty plea.

    https://www.redstate.com/shipwreckedcrew/2020/05/12/very-likely-judge-emmet-sullivan-committed-error-in-connection-with-flynn-sentencing/

SULLIVAN: These are questions that you [ prosecution ] would be prepared to answer anyway, such as, you know, how the government’s investigation was impeded? What was the material impact of the criminality? Things like that.

Sullivan never established the material importance of Flynn’s guilty plea, which is required by law. It’s a long piece, I’m just excerpting a bit

Sean Henry (Crowdstrike) lied to Congress

To explain how Russia could have stolen the emails without any trace of them actually leaving the DNC server, Crowdstrike President Shawn Henry improbably told Congress that GRU could have taken “screenshots” of each email as DNC staffers read them. That’s a lot of screenshots!

    except wiki published them w/attachments

    https://twitter.com/aaronjmate/status/1260595976567492611

Also, I’m pretty sure a screen shot is treated as an object, whereas you can manipulate the actual text of an email if it’s a true copy. I should probably test that.

Now, I’m not anti devils lettuce, but it’s still classified as a Schedule I drug by the federal government, how can Congress then provide guidance on how states run what amounts to illegal enterprises? A lot of Californians did not vote for Trump in 2016 simply because they thought it was a waste of time and effort.

It will be different in November. Trump will take district 25; you heard it here first.

I agree with you that this election will be different. Nothing proves that you can win the next one than winning the last one. I also think that Trumps approval is higher than the polls show. Today, Representatives Kevin McCarthy (CA-21), Devin Nunes (CA-22), Ken Calvert (CA-42), Tom McClintock (CA-04), Doug LaMalfa (CA-01), and Paul Cook (CA-08) issued the following statement in response to the U.S. District Court for the Eastern District of California’s preliminary injunction in Governor Gavin Newsom’s lawsuit to deny Californians much-needed water:

“With yesterday’s temporary court ruling, the Newsom Administration was successful in denying California communities over 50,000 acre-feet of much-needed water in the month of May alone. Their actions prioritize politics over the needs of working Californians across our state. Even after the Trump Administration spent months consulting state agencies on the updated biological opinions, Governor Newsom has still decided to sue the federal government and issue its own state permit to block water supplies.

On Wednesday, Biden took his campaign to another corner of the internet, appearing on Good Luck America, Snapchat’s daily political show hosted by Peter Hamby. For all the questions about the 77-year-old’s digital savvy, this week’s interview marks his third appearance on the Snapchat show since 2016.

Speaking of Harvard, the Shorenstein Center up at Harvard did an analysis of all of the anti-Biden memes out there on the internet. According to them, the top three slogans they’re seeing, this is from the left and the right, are Dementia Joe, Sleepy Joe, Creepy Joe. Barack Obama reportedly said last week that his daughters had been showing him anti-Biden TikToks. Basically, there’s an entire discourse on the internet right now that’s painting you as creepy and old and out of touch and kind of lame. How do you fight back against that?

    My day today.

Twin kittens, almost identical so difficult to identify. One is however weighs 8oz less than other one. Why?

About 10am one kitten severe vomiting. And I mean really going for it. Grabbed non-vomiting kitten and identified it. Yep, sometimes it is better to know which one it is not.

Vomiting kitten is the one that weighs less.

About 1pm the kitten that weighs less entered the litter box. Why did I know? because I was waiting for it.

He took several attempts to position himself to do what cats do. So long in fact I started to get worried.

Eventually he shit. I was pleased and lifted him out of shit box before he could cover it up. Scooped his deposit out and took it to kitchen sink to examine it.

Little cat was not happy I stole his shit… LOL

Anyway, 10 minutes of warm water and dissection of the cat shit and I only discovered a small piece of paper that could have once been an Amazon shipping label.

I was worried that kitten had eaten something that caused an intestinal blockage.

Anyway, all cats shitting normally now. Eating normally and who and what chewed the window blinds today?

Looks like I will be examining cat shit again tomorrow to discover the culprit.

    🙁

Technically when you hit send it is a HTTP POST internet thingy.

    https://en.wikipedia.org/wiki/POST_(HTTP)

In computing, POST is a request method supported by HTTP used by the World Wide Web. By design, the POST request method requests that a web server accepts the data enclosed in the body of the request message, most likely for storing it.[1] It is often used when uploading a file or when submitting a completed web form.

Judge Sullivan has now appointed a retired judge to look into “whether the Court should issue an Order to Show Cause why Mr. Flynn should not be held in criminal contempt for perjury.” Thus, the court is not only considering denying an uncontested motion for dismissal but…

…but considering a new charge based on Flynn’s effort to withdraw his plea. Consider the implications for many cases where defendants seek to withdraw pleas due to prosecutorial abuse. It would create a threat of a judicial charge even when prosecutors agree with defendants.

Here is another POV. Sullivan does not have authority to deny the motion to dismiss based on his disagreement with it. Therefore, this is a way to completely exonerate Flynn and protect him from further prosecution (via the perjury charge).

    https://twitter.com/rra/status/1260725725826555905

Sullivan just did Flynn a huge favor, opening the door, IN HIS COURT, to have the plea deal examined as well as the conduct of Covington. Sullivan will have it all exposed. The “leave of court” can’t be undone by the judge. Half the work for Flynn’s lawsuit will be done.

Sullivan gets the benefit of leaving no stone un-turned before he is out of the picture, minimizing risk of an upper court or subsequent prosecution attempt on Flynn. Real exoneration for Flynn can come from this, not just a dismissal “because of political irregularities”

There’s a blurb at the link I can’t copy but it’s the legal text, you should read it, it explains the very limited scope of Sullivan’s authority

  165. 169 | May 13, 2020 9:27 pm

    @ eaglesoars:
Concern as China targets Pacific mobile networks
    Andrew Clark and Angus Grigg
    May 14, 2020

The state-owned China Mobile is looking to buy the biggest phone carrier in the Pacific Islands, Digicel, in a deal that has raised concerns in Canberra and opened a new front in Beijing’s battle for influence in the region.

The potential deal, which could be worth as much as $US900 million ($1.4 billion), will inject new tension into the Australia-China relationship and follows a week of trade disputes over barley, beef and steel.

The Australian Financial Review has been told a consortium led by a senior Australian telecommunications executive is putting together a rival bid to China Mobile, but it may require a federal government loan guarantee to secure the assets.

Australia was forced to finance the Coral Sea Cable, connecting Port Moresby, Honiara and Sydney, to block China’s Huawei from building it. DFAT
While Australia would usually baulk at intervening in a private business deal, Canberra would be equally wary of a Chinese state-owned enterprise gaining such a large footprint across the Pacific.
Security sources in Canberra said they were aware of the potential sale and were concerned about the strategic implications, while the Department of Foreign Affairs and Trade said it would “continue to monitor this issue”.

It stressed the “importance of high quality, secure telecommunication services for our Pacific partners”.
“The Australian government wants to see infrastructure investment in the Pacific, including in communications, that is transparent, robust and which ensures high quality and low costs for people and business,” DFAT said.
The potential purchase of Digicel by China Mobile comes just two years after the federal government was forced to majority fund an undersea cable in the Pacific to stop it being built by Chinese firm Huawei.
The cable from Solomon Islands and Papua New Guinea to Sydney, cost $136 million, and was funded two thirds by Australia’s overseas aid program.
Digicel, founded by Irish billionaire Denis O’Brien, is the biggest mobile phone carrier in PNG, Vanuatu, Fiji, Solomon Islands, Tonga and Samoa. It is second to Vodafone in Fiji.
But the company, which also has operations in Central America and the Caribbean along with the Pacific, is struggling under $US6.7 billion of debt and is facing looming repayment deadlines over the next 30 months.
Sources involved in the negotiations said China Mobile had been conducting due diligence on Digicel’s Pacific business since the start of this year, which would be spun off from the main company before any sale.
China Mobile did not respond to emailed questions.
The Financial Review has been told any sale price would be dependent on how much debt was taken on by the new Pacific business. That means a price tag of anywhere between $US1 million and $US900 million has been discussed.
The rival Australian consortium is seeking investors from Europe and the United States, along with those based locally.
While Australia is the biggest aid donor to the Pacific and has traditionally regarded the region as its sphere of influence, Canberra has no formal ability to block any deal involving China Mobile.
PNG’s telecommunications minister, Timothy Masiu, said he was aware of Digicel’s financial troubles but had not been informed about any deal with China Mobile.
“When we are officially told we will formulate a position,” he said via phone.
However, he indicated the government had limited avenues to block a Chinese takeover of the country’s dominant mobile phone carrier.
“It’s a business deal,” he said.
After blocking Huawei from participating in Australia’s National Broadband Network, the Turnbull government was worried China could use the undersea cable to gain a foothold in the Pacific and potentially spy on the region.
It later stopped Huawei from participating in the roll-out of Australia’s new 5G network.
The cable deal came at a time when the Turnbull government was embarking on its Pacific step-up and pushing back against Beijing’s effort to exert greater influence in the region – a step-up accelerated under Mr Turnbull’s successor, Scott Morrison.
China Mobile’s interest in Digicel comes at an awkward time for the Morrison government, which is fighting a trade war with Beijing over barley, beef and steel.
On Sunday, China indicated it would slug barley growers with an import tariff of up to 80 per cent, a move that would make Australian farmers uncompetitive and destroy one of their biggest export markets.
Then on Tuesday, it emerged that four Australian abattoirs had been banned from selling beef to China, a market that accounts for 25 per cent of Australian exports.
Federal government sources insist the trade dispute was linked to its banning of Huawei and calls for an international inquiry into the origins of the COVID-19 pandemic.
But on Wednesday, Trade Minister Simon Birmingham acknowledged Beijing had complained about Australia’s anti dumping regime, which levies tariffs as high as 140 per cent on Chinese steel, aluminium and chemical products.

Last nite a guest on Laura Ingraham’s show talked about the Fokker decision vis a vis Sullivan’s ploy to get Flynn convicted and how it completely disallows what Sullivan is trying to do.

Margot Cleveland explains what the decision says and also what a writ of mandamus is, which is what Barbarian and I have been talking about.

“The Executive’s primacy in criminal charging decisions is long settled. That authority stems from the Constitution’s delegation of ‘take Care’ duties, U.S. Const. art. II, § 3, and the pardon power, id. § 2, to the Executive Branch. Decisions to initiate charges, or to dismiss charges once brought, ‘lie[] at the core of the Executive’s duty to see to the faithful execution of the laws.’”

Sullivan has violated separation of powers.

    @ The Barbarian:

But according to the Fokker decision, he IS blameless for the result.

I’m wondering if it has something to do with the reversible error he made accepting Flynn’s guilty plea. The motion to dismiss said what Flynn supposedly lied about was not material to any investigation, therefore was not prosecutable.

That piece from redstate I posted yesterday said Sullivan erred in accepting the guilty plea because he NEVER ESTABLISHED it – the supposed lie – was material in any way, which is a legal requirement.

So the motion to dismiss goes DIRECTLY to Sullivan’s reversible error. You would think that Sullivan would therefore welcome the motion to dismiss (with prejudice), but I’m wondering if there’s a legal conundrum introduced that I’m missing.

I couldn’t agree more. This is what I cannot understand – WHY in the world Sullivan wants to prolong this, especially when it has been revealed exactly how far the FBI and Mueller probe were willing to go to manufacture a charge against him – a charge that they had no INTENTION of taking to trial, putting more and more pressure for him to accept a guilty plea. Why? If you have the case, you go to trial. They hardly worried about squandering funds for a trial.

Of course, if you go to trial, there is discovery. And Brady requests. If he pleads, nothing comes to light. I think they didn’t want to risk document production to the defense. And witnesses under oath.

The 4th Circuit allowing it to go forward doesn’t surprise me. We had the 9th Circuit kick back THREE 12(b)(6) orders of dismissal on one case, so we completed discovery and then filed a motion for summary judgment. It was granted and of course, appealed. This time, because the record was more complete, the 9th sustained the grant. I haven’t followed this case, but I imagine it’s much the same.

It’s okay that I got caught. I wasn’t doing much anyway, now that all the home projects are completed. Falling on my sword for Le Resistance is the very least I could do. I took off all my clothes and smeared excrement all over the place, just for authenticity. Frau Vhitmer’s been trying to break into my cell to ravish me, but luckily I was able to lock the door from inside and brace it with a castle-quality railroad-tie laid into heavy cast-iron brackets. Actually THAT is the WHOLE POINT.
To hive off NZ and Australia from the 5 Eyes and push the USN back to Hawaii and out of the Western Pacific.

The US needs B-2 and B-52 bases at Tindall AFB and they need them NOW. The major extensions have almost been completed and the base aircraft housing is underway. The Chinese wharf extensions and control of Darwin Port need to be rolled back, and the Australian government needs to take back control of Darwin Port from China using Strategic Emergency legislation. The USN can then move into brand new military ready Chinese built barracks in Darwin.

It’d REALY rip China a new one but why not?

The grab back and nullification of the 99 year lease at Darwin could also be merged into the general reparations package levied on China over the Wuhan virus.

    It’s called PUSHBACK!

    4 dead per million

Basically NZ’s socialist government Locked down too late by 10 days to 2 weeks. Then went too far with a brutal lockdown that had severe economic fallout.

Fortunately NZ had VERY LOW unemployment before Wuhan virus. It’s expected to top out at 10% and debt will double from 20% GDP to 40% GDP as a consequence. Still very low given the rest of the world.

Being an Island of 5 million the borders are VERY easily closed but China is now ‘monstering NZ to try to hive it off from the US and Australia.

Another Bizarre Twist In Flynn’s Case: ‘Covington and Burling’ Will Enter Case At Judge’s Invitation

In another strange turn of events, Judge Emmet G. Sullivan has invited Michael Flynn’s former defense counsel to appear as interested parties in their former clients ongoing case. Sullivan, who did not agree to drop the charges against Flynn as requested by the Department of Justice, did not specify the purpose for inviting the former lawyers to appear in court.

John Hall electronically filed the notice on Thursday, as the legal representative for Covington and Burling, Flynn’s former defense counsel.

Here he is being wrong about Florida back on Apr. 1st
    https://floridapolitics.com/archives/326243-former-surgeon-general-stay-at-home-order

Former U.S. Surgeon General Vivek Murthy is urging Gov. Ron DeSantis to institute a statewide stay-at-home order “right now,” arguing the move is necessary to keep the spread of the COVID-19 virus under control.

“If you care about saving lives, if you care about the long-term health of the economy, you’ve got to issue those orders right now,” Murthy told Jim DeFede of CBS Miami.

“It should’ve been done, frankly, weeks ago throughout the entire country. And every day that we wait is a day that the virus continues to spread.”

    https://www.foxnews.com/opinion/coronavirus-nursing-homes-desantis-cuomo-life-and-death-deroy-murdock

Any 10-year-old who has watched just five minutes of COVID-19 news would have learned one thing: Maximize the distance between this virus and the elderly. This typically frail population is COVID-19’s easiest prey.

Until Sunday, this most-basic lesson totally escaped Gov. Andrew Cuomo, D-N.Y., 62. But this warning propelled the COVID-19 response of Gov. Ron DeSantis, R-Fla., 41. Their divergent results are shocking: As of Friday, COVID-19 had killed 5,352 seniors in Empire State nursing homes. This pathogen had slayed 665 elders in Florida’s such facilities, despite its larger population.

How could New York and Florida — America’s fourth- and third-most-populous states — have yielded such drastically, tragically, disparate results?

    It’s the nursing homes stupid.

Trump allies push ‘Obamagate,’ but record fails to back them up

Trump and his supporters have charged that Barack Obama and Joe Biden conspired against Michael Flynn, but there’s no hard evidence to support the claims.

President Donald Trump and his allies have begun escalating their attacks against former President Barack Obama and former Vice President Joe Biden, the apparent 2020 Democratic nominee, by accusing them and other Obama administration officials of conspiring against Trump’s first national security adviser, Michael Flynn.

Trump and his allies call it “Obamagate,” and the claims are multifold: that Obama and Biden had advance knowledge of the FBI’s plans to interview Flynn about phone calls he had with the Russian ambassador to the U.S. during the 2017 presidential transition period; and that Biden nefariously requested the “unmasking” of Flynn, who was an unnamed American who turned up in intelligence collected from the communications of foreigners under U.S. surveillance.

Sullivan is just plain politics by trying to force Flynn to have to endure further charges and expense. What Sullivan REALLY WANTS is for Trump to have to step in a give Flynn a pardon. That would enrage the left and give them ammunition to fire back at Trump.

Breaking down ‘Obamagate,’ Trump’s latest theory about the ‘deep state’ and Obama’s role in the Russia investigation

President Donald Trump and his allies added a new dimension this week to their “deep state” conspiracy theory, directly accusing former President Barack Obama of leading a supposed “coup” to sabotage the Trump presidency.

Seizing on a viral hashtag, Trump dubbed the alleged scandal “Obamagate” and has been flooding the zone promoting exaggerated theories and false claims since the weekend. In the President’s view, he was the victim of the “biggest political crime in American history” and the Obama appointees who he claims tried to undermine his administration deserve jail time for their misdeeds.

Trump ramped up his rhetoric over the weekend after Obama criticized the Justice Department for dropping its criminal case against former Trump national security adviser Michael Flynn. Trump’s new focus on Obama also served as a diversion from the coronavirus pandemic, as the nationwide death toll passed 80,000 and the unemployment rate tripled to a staggering 14.7%.

For years, Trump has claimed without proof that Democratic partisans within the Justice Department and the FBI abused their powers to investigate members of his campaign and undermine his presidency. “Obamagate” appears to be an extension of this underlying theory, which is part of the President’s sustained effort to rewrite the history of the Russia investigation.

Really? He owns a “compound” with 2 houses in it. In addition to other houses that the Heinz-Kerrys own.

Just realized that flu season is only about 6 months away. Can’t wait to find out what we’re not allowed to do then.

Good morning. Rumors are that Joe Biden will name Dean Vernon Wormer as Secretary of Coronavirus Quarantine and Director of Gulag Services.

Kristoll is a joke. His attempts to vault himself back to relevancy are laughable at best. He, Jennifer Rubin, Max Boot and David Frum literally serve no purpose other than to give CNN and MSNBC cover as featuring “opposing” viewpoints. No one considers them anything more than opportunistic sellouts and shills for the left.

    Jennifer Rubin is certifiable.

Good morning. I am seeing something about an earthquake in southern Cal, maybe 6.3. Not small, but I don’t know what’s average for that area.

    @ rain of lead:
