First Victory in a Long, Long, War

Yesterday, I heard of a group calling themselves, “No Labels.”  Make no mistake, this is a group of Democrats who were recently removed from office by angered voters.  They are trying to paint themselves as the true voice of America, angered by the great and ugly, “Partisan Divide.”  Make no mistake however, they are nothing more than professional leftists committed to yet another attempt to hide what and who they truly are.  This time, the angry cry is that they are mad that no one will take them seriously.  What poppy cock, that this group of posers feels the right to be taken seriously.  I keep a copy of the Constitution in my office, and I have yet to see that particular right anywhere.  We all have the right to free speech.  That is true, but that is not the same thing as compelling people to listen.  Listening, and taking seriously is left up to each individual, (at least currently, not withstanding the current assault on the Constitution by the Obama Administration.)  So, before we all get carried away by the seemingly sanity laden No Labels group, let’s recognize them for who and what they are.  They are the latest attempt of the professional left to fool us into thinking we are voting once again for the mainstream center while putting the same group of Marxists and socialists into positions of authority.

Now look at the past, so that we may learn from history, rather than repeating it.  In 2005, David Axelrod and Nancy Pelosi went on a recruiting expedition to attract center right Democrats to run for Congressional office.  The plan was repeated in 2007.  The results were extremely successful.  By the end of the 2008 elections, the Democrats had a huge majority in both houses of Congress.  The voters were upset with Republicans who had run as conservatives and waffled on their principles in the great effort to appease the left and gain acceptance from the media.  (John McCain is the clearest example there is of this.)  The Democrats by contrast had a fresh batch of relatively unknown and thus somewhat innocent candidates, who all sounded more like Republicans on the campaign stump than like Democrats.  The results were a shellacking for the GOP at the polls in two straight elections.  This was followed by endless left punditry claiming the death of the Republican party, and a brash statement that we in America were now Socialists.

Not so fast.  Yesterday’s court ruling in Virginia is the end result of governing against the will of the people.  Obama got elected by largely not telling us mere citizens what his plans for the most powerful office in the land were.  Those large majorities in both houses of Congress were gained by not telling their constituents what their plans for office were.  The legislation, which had to be rushed through a vote without having been read or debated represented a vast departure from the will of the people.  It was made possible by the governed being tricked by candidates.  That is nothing new.  What the candidates learned however is that governing is different than campaigning.  The power of the Presidency is only as long as the consent of the governed is still there.  President Obama is a little upset, mostly because he is learning the hard way that he is not King Obama.

Now, the other shoe has dropped.  the forgotten thing the politicians of the Legislative and Executive branches have just been reminded of is the third and equal branch of our government.  The Judicial branch has spoken.  The Health Care Law, as terrible and monstrous as it is, is also unconstitutional.  Obama will try to fight for it, but in the end, this baby ain’t surviving.  We, the people have won a temporary victory against the leftists who wouldn’t die.  This temporary victory was granted us by the foresight of the founding fathers.  We were saved by their work.  Before we spend time celebrating though, we have the recognize the undead nature of the enemy.  When the Berlin Wall fell, we thought we were well rid of the leftists.  Not so, they changed their name to progressives, and they took over our Congress and Presidency.  Now that they have been recognized there, they are slinking back into the shadows, and they are regrouping.  Their next incarnation is No Labels.

Let us not repeat the mistake of 95, keep vigilant, and keep letting your representatives know that we don’t want any more capitulation of ideals going on.  When you hear your Congressman or Senator say the words compromise, bi-partisan, reach across the aisle, or any other sign of capitulation, flood his/her office with phone calls, e-mails, and letters to show your anger.  The price of failure is the Socialism of the last two years.

The Model Cities Program, What Was the Aftermath?

There is an assumption made in our country which I find troubling.  That assumption is that we live in a vacuum cut off from our memories and evidence of current events which could shape our opinions.  You probably need a few examples to understand, in context, what the heck I am talking about.  Sometimes I’ll hear someone on the left refer to the, “discredited supply side policies of the past 8 years,”  like the principles of a free market economy didn’t produce the wealthiest nation on the planet for the past 230 years.  Sometimes I’ll hear someone on the left say, Canada and England have nationalized medical care which provide models we should follow, as if those systems haven’t in fact turned into complete disasters and act as a noose around the necks of the citizens of those nations.  Proof of this is a full 57% of British Citizens admitting to performing their own woodshed tooth extractions despite having full free dental care provided.  The traffic of Canadian Citizens popping up in American hospitals for cash only medical care staggers the imagination, especially considering their medical care is provided free.  (In the previous two examples, free is the wrong word.  there is a cost, it is just not paid by the individual citizen.)  We are told endlessly by liberals how we need to spend more on public schools in urban areas because it is not fair that the education there lags behind those in suburban areas.  Guess what, the 10 school districts which spend the most per student are also the 10 worst performing school districts in the country.

We have tried the policies the left advocates, just not on a national level.  As it turns out, we have wonderful laboratories where liberalism has been allowed to reign, unchecked for decades at a time.  One of those areas holds a special place in my heart.  I lived in the Detroit area for 5 years, and can identify with the people who fell prey to the policies offered as a solution for the rest of us.  I understand the desire of every person to help those people who need help, the question is, what is the best way to avoid those things which tug on our heart strings.  When the policies people advocate to mitigate the disastrous effects of previous attempts at social engineering cause the problems which are so objectionable, at what point do we stop and reverse course?  The best way to help people in need is allow them to pull themselves out of that strata of society.

Detroit was a model city before the program, in fact it was in many ways the envy of the rest of the country.  $400 Million from the taxpayers into the city in 1965 ultimately produced the results you see above.  Think long and hard about what tomorrows vote looks like.  If we as a nation continue down the Socialist path, this is what our future looks like.

Unions to Obama: We Want Our Payback!

Another one of those under the radar things. This time we are going to screw the independent truckers in the country. First, let me say that I am not a trucker, nor an expert on that industry. This is more about allowing people to make their own decisions regarding their own destiny in life. This is the principles our Country was founded on. A friend pointed me to this Wall Street Journal article yesterday.

After reading it, I actually got a little angry with the whole notion of people pretending to be vanguards for the public good, while clearly enhancing their own self interests.

The gist of it is this, The Teamsters and the SEIU have teamed up to commission a study. The study found that independent truckers who are 1099 employees should instead be classified as W-2 employees. This would force the entire class of owner operators to be hired by the people they drive for, rather than contracting their services as private owners of businesses. The result to our knights in shining armor would be twofold. First, the membership of the unions would immediately increase, as every W-2 trucker in the country would now be driving for a union shop. State and Federal Governments would win, as W-2 employees generally carry increased tax ability, both to the worker, and the business that hires them. If these guys are the winners, who are the losers, guess.

I do have a lot of clients who are truck drivers. This is not because of any expertise in their under appreciated line of work. It is solely because my next door neighbor is a CPA who has found a niche in the accounting market for doing the tax work for truckers. When they express a need for what I do, he sends them to me. I have learned a lot from my conversations with them. One of the things that I have learned is that there is a lot of choice available to them as to how they wish to be paid. Those who wish to be owner operators are able to find work doing so. Those who wish to be W-2 employees are able to do so. There are even companies out there that offer both payment paths for their drivers. I have no idea why drivers choose one over the other. What I do know, is that the choice is theirs, at least currently.

Unions are stepping up a campaign to get the Obama administration to crack down on companies that treat workers as independent contractors instead of employees—a practice that effectively puts tens of thousands of workers out of reach of labor organizers.

Change to Win, a labor coalition that includes the Teamsters and the Service Employees International Union, will release Wednesday a report critical of trucking companies that serve big ports, charging they improperly classify many truck drivers as independent contractors. Whether workers are employees or contractors is a contentious issue across a range of industries including construction, home health care, and transportation.

“We plan to use this report as further proof to take to the administration to say ‘we know you want to help, you need to do it more quickly,”‘ said Fred Potter, director of the Teamsters port division and a vice president for the union. He and other union officials plan to push the government to file lawsuits and boost enforcement of relevant tax, employment and safety laws.

What is obvious from the above excerpt, is that the Unions are going to try to paint a picture that they are merely acting as self appointed nanny’s for the poor truckers who for some unexplained reason are unable to watch out for their own interests.

Robert Digges, chief counsel for the American Trucking Associations, an industry trade group, said most port truck drivers are indeed independent contractors—but legally. This gives drivers flexibility, said Mr. Digges, though he’s concerned about being challenged because it could lead to costly litigation.

“All of this is just to simply turn these people into employees one way or another so that unions can make the effort to organize them,” he said.

What we see here from the Lawyer that the independent truckers have hired is that they are aware enough of their own interests to fight the unions and prevent this from happening. So where does President Obama, the Messianic representative of the little guy fall on this issue?

Mr. Obama’s federal budget for fiscal 2011 allotted money and outlined plans for the Internal Revenue Service and the Labor Department to work together to address the issue.

This includes more enforcement agents for the Labor Department and more proposed help for the IRS to determine how to properly clarify worker status. Still, some union officials say they want faster results.

Vice President Joe Biden has said that stopping worker misclassification remains a priority for President Barack Obama’s Middle Class Task Force.

In short, the American Dream is to have flexibility and control over our own destinies. It is not to have government bureaucrats take over the decision making process of our lives, and to then allow us whatever standard of living those bureaucrats deem fit. This amounts to nothing more than a strong arm tactic by Democrat approved thugs to gain control over the lives of people who choose to own and operate their very own business, and it is wrong.

Process Crimes and Moral Equivalence

Welcome to 2010, where all crimes and sins can be made equal, given the right set of logical acrobatics. Welcome to 2010, where if a prosecutor isn’t able to prove an actual crime has taken place, he will just charge someone, anyone, with a process crime. What is a process crime, you might ask. Simply put, it is a crime committed during an investigation of another crime. Three examples come to mind, each of them equally wrong. President Bill Clinton was charged with lying to a Grand Jury about whether or not he had sex with the help. This occurred while he was being investigated for the White Water Land Scandal. There was insufficient evidence to charge him or Hillary with any crime related to that, so a frustrated Ken Starr charged him with perjury, which occurred in the process of the crime which didn’t occur, (at least it wasn’t committed by the Clintons.) Martha Stewart was investigated for insider trading. The prosecutor was unable to gain enough evidence to prove that the crime of insider trading even occurred. Martha was charged and convicted on a charge of Obstruction of Justice, for not answering the Federal Prosecutors requests for information in a timely manner. In Stewart’s case, she was charged and convinced in a process crime where the underlying investigation revealed that no crime had actually taken place. Scooter Libby, was charged in a process crime of Lying to a Federal Investigator for leaking the name of a non-covert intelligence operative, where once again, that investigation showed that no actual crime had occurred.

All three of these crimes were wrong to prosecute. This conversation is not solely about process crimes. It is also about moral equivalence. Moral equivalence is the thing which upsets me about the political left more than any other. Moral equivalence occurs when we allow ourselves to suspend discriminating thought. Here is an extreme example of moral equivalence. When somebody notices that a group of religious zealots hijacks and flies airplanes into buildings killing everyone of the airplane and a whole bunch of people in the building. When they further notice that those religious zealots are indeed Muslims chanting, “Allahu Akbar.” They might be inclined to say, we need to protect ourselves against Muslim Zealots, there will always be a group of people who will bleat on about those annoying Family Planning Picketers being just the same, and that we need to be just as wary of them as well. After all, one religious zealot is the same as another. Well, not quite. While the picketers are supremely annoying, they are actively attempting and succeeding at killing 3000 random people. It is true that the picketing zealots will occasionally commit acts of violence, which I do not condone by the way, typically their violence occurs at night and is exacted on buildings they believe will be empty, or targeted against individuals. Don’t misunderstand me, they deserve to be punished for their crimes. I’m just trying to point out that the depravity is not equal, or even close. There are degrees of wickedness.

Which brings me to this.

The Wiki leaks scandal, and the prosecution of Scooter Libby are not the same, not by a long shot. first off, Scooter Libby did not leak the name of Valerie Plame. Richard Armitage leaked the name of Valerie Plame. The prosecutor knew that Armitage was the name leaker prior to his even interviewing Libby, which by the way makes this process crime even worse to prosecute than the others. Richard Armitage was a Clinton appointee who was kept in his role by Bush 43 at the recommendation of Secretary Powell. He leaked Plame’s name because he was simply a gossip. He did not have some raging axe to grind. He didn’t have some nefarious scheme to hurt the country or strike a blow against the current administration. He just had a big mouth, and liked being the guy who knew everything. In retrospect, he probably wasn’t a good fit for the State Department. Wiki Leaks occurred because an army Iintelligence Officer hated his country, and the Army in which he served. He had a nefarious scheme to do damage to his country and to do damage to the Army. His accomplice had a nefarious desire to damage any government he could damage, and has vowed to find ways to similarly damage other governments at his first opportunity. That Alan Colmes, and by proxy, people on the political left are trying to equate these two events is intellectually dishonest. By printing these leaked documents, the NYT is damaging the country. By printing the name of Valerie Plame, the NYT damaged only Valerie Plame, and the political left. Valerie Plame by the way called attention to herself, by printing an Op Ed in the same NYT attacking the Bush Administration during a Presidential Campaign. Had she and her husband not posted an Op Ed, her name would still be a super secret today.
