I would have put something up earlier, but I was busy celebrating at the oral surgeon in Albuquerque…

    We’re sitting about 10 degrees celsius lower than normal. Two degrees colder then the previous record low. Of course the station that we get our weather readings from has only been in existence for about 15 years.

    After nearly six months of protests in Hong Kong, the weekend demonstrations – which more closely resemble street skirmishes between black-clad protesters and the cops – have grown increasingly violent, people are being seriously wounded and even killed on both sides. And this week, protesters have apparently committed to another escalation: they’ve taken to the streets to disrupt HK’s public transportation during Monday and Tuesday, forcing businesses to close and schools to cancel.

    Hong Kong policed warned on Tuesday that the city is now “on the brink of total collapse” after a second straight day of violence and chaos. The MTR, Hong Kong’s subway network, closed several stations and reduced the frequency of trains to cope with the demonstrations.

    It appears that everyone is freaking out because the Supreme Court is allowing the lawsuit against Remington by the Newtown parents to go forward and not granting cert under the 2005 law that gives gun owners immunity from lawsuits over use of their products.

    There are a thousand different reasons for the Supreme Court to let this play out. First of all, it’s a state case and should proceed accordingly. Second, better to have a final judgment on which to base a ruling than, essentially, a case not yet adjudicated. Remember, they took up the cause of the gay baker only AFTER he was found liable to the snots who sued him.

    Also, while I understand that the parents rightfully want to blame SOMEONE for the horror of that day, and the monster who committed it is dead, I would very much be surprised if a jury found Remington liable.

    What I am curious about is why the defendants didn’t remove this case to federal court under diversity jurisdiction. Then they would have had a better argument for a 12(b)(6) motion to dismiss under the 2005 law.

    I think Remington’s attorneys were hoping to get SCOTUS to extend the PLCAA protections to state courts.

    There’s a part of me that wonders if the Supreme Court simply wants these parents to have their day in court. There’s time for appeal if the jury finds the manufacturer guilty.

    Plus, I’m sure the defendants will file a Motion for Judgment Notwithstanding the Verdict if the jury finds for the plaintiffs. Basically it says the jury ignored the law, ignored the evidence and got it wrong. Judge can overturn jury verdict – that becomes subject for the appeal, and it can go up all the way.

    Also, the Supreme Court is more likely to allow the parties to have their day in court at this stage rather than not permit it.

    Schiffty’s in it up to his pencil neck. Now that we know his name, all sorts of comprising information is coming out about this jerk. Schiffty is starting to worry that his ridiculous cast of characters are going to be eviserated by the GOP in the hearings.

    I hope they do what they’ve hinted at – reassign Jim Jordan temporarily to the Intelligence Committee. Schiffty’s worst nightmare.

    Cardinal George Pell gets his day in court.

    Only 1 in 10 cases on appeal to the Supreme court of Australia. get to be heard. Pell’s case made the cut thank God!

    Now let’s see what a full bench of Federal Judges make of this Victoria State court of appeals Kangaroo Court travesty of justice.

    In the meantime Cardinal Pell has been locked up isolation for 9 months, denied full access to visitors and very limited access to his lawyers, kept in solitary confinement, denied the ability to say Mass or receive communion and spends his time in his assigned job pulling weeds from the prison yard whenever it is empty. At least now he actually gets out of his cell occasionally to do this job. The State of Victoria (the Peoples’ Socialist Republik of Victoria) ( akin to Ca on steroids)is a cruel place for anyone that they perceive as their ideological enemy!

    Salem communications fouls up everything it touches. It screwed up HotAir, it is now screwing up Twitchy. Michelle Malkin is good at coming up with good ideas and cashing in on them but the people who have bought her stuff have no concept of who their audience is.

    Twitchy is interesting, but it’s not a worth it to pay for it site, it’s a site that should let ad revenue drive it. …. and they don’t have to be intrusive ads., If these places would just use in-line ads, they’d be fine

    The ones I feel the MOST sorry for are people in office buildings that will be forced to look at her ugly mug all day from their office windows. Although, judging from the location as far as I can determine from the nearby buildings, it will probably be the people staying in the downtown hotels at Union Street.

    I expect to see a lawsuit to have it removed. By the Tourism Board.

    Of course, there isn’t a WORD in that transcript that says “I’ll GIVE you this if you do that.” There isn’t a WORD in that transcript that says “I WON’T give you this if you DON’T do that.”

    However, we do have a really cool videotape that says “you have six hours to fire the prosecutor or I’m leaving here with the money.” Wonder if Schiffty is working overtime to get Trump’s head photoshopped in.

    They are not going thru this shit show in the House for nothing.
