    The President’s Constitutional Plan.

    It involves two steps, or two fronts: First the Courts, then the House.

    -The Trump Campaign, RNC, various state GOP Parties, third party organizations, are filing county, state, and federal lawsuits.

    -The primary objective is to strategically get several ballots invalidated.

    -However, a secondary objective is to publicly expose “corruption” in these cities to both STATE reps and US House and Senate Leaders. This is crucial.

    -While keeping the 73 million Trump supporters engaged and working behind the scenes.

    -There seems to be success in this, as two polls show 60% of the US now believe “fraud” occurred and only 49% believe Biden won. These polls have a 37-32 D:R bias.

    -Keep in mind, MSM “calls” are merely “projections” of how a state voted in the popular vote. Strictly speaking, they means nothing.

    -Win, or lose in court, the next step is the GOP State Legislatures (SLs) in PA, MI, WI, AZ and GA.

    A Republic, not a Democracy.

    -On December 14, 2020, Certified Electors from each state, cast their ballots for the President and VP. What many do not realize is they vote in their home state and their vote is sealed and NOT “counted” until January 6th. Crucial point.

    -Now, the SLs [state legislatures] have the Constitutional authority (under Article II, Section 1, Clause 3 and 3 U.S. Code § 2 and § 5) to appoint their own slate of Electors, loyal to President Trump, if they deem their state’s “POPULAR VOTE IS CORRUPTED”.

    -In other words, the State GOP Legislature of Georgia, for example, can “conclude that the popular vote has been corrupted” and appoint a “competing slate” of electors, loyal to President Trump. For example, 20 Biden Electors from PA & 20 for Trump.

    -The precedent for this is the 1876 Election when SC, LA, FL and (1 EV from OR) each sent competing Dem and Repub Electoral votes, sealed, to the archivist in D.C.

    -Keep in mind, NOTHING is “counted” yet. Another crucial point.

    -On January 6, the 12th Amendment to the Constitution specifies that the “President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates and the votes shall then be counted.”

    -That means that in the case of disputes about competing electoral slates, the President of the Senate—Vice President Pence—would appear to have the ultimate authority to decide which to accept and which to reject. This is supported by 3 U.S. Code § 15. Hence, Trump wins.

    -This is a de facto check on the Electoral College, which few realize because it only happened in 1876.

    -If at that point, nobody gets to 270, the 12th Amendment stipulates, “the House of Representatives shall choose immediately, by ballot, the President. But in choosing the President, the votes shall be taken by states, the representation from each state having one vote.”

    -Currently, Republicans have a state delegation majority with 26 (likely 30 in the new Congress) out of 50. Ergo, Trump wins.

    -Prez Trump has clearly discussed and been briefed on a strategy to contest the election via Constitutional means, first through the courts and then…

    …through House, saying at a Sept. 26 rally in—where else—Pennsylvania: “And I don’t want to end up in the Supreme Court and I don’t want to go back to Congress either, even though we have an advantage if we go back to Congress — does everyone understand that? I think it’s….

    ..26 to 22 or something because it’s counted one vote per state, so we actually have an advantage. Oh, they’re going to be thrilled to hear that.”

    NO clearer indication exists that this was his plan all along.

    There’s more to the thread but you get the idea. AND – this was posted almost a month ago.

    I’ve also been seeing something about Nevada sending TWO slates of electors, one for Trump but I can’t found a source outside twitter, so consider unconfirmed. But it seems if it IS true, Pence gets to choose.

    Kash Patel, the chief of staff to Acting Secretary of Defense Christopher Miller, has filed a $50 million defamation lawsuit against CNN and several of its top reporters, claiming the liberal network published false statements and promoted “unfounded left-wing political narratives” by painting Patel as a pro-Trump conspiracy theorist seeking to smear President-elect Joe Biden.

    The complaint filed on Friday in Virginia Circuit Court named CNN reporters Barbara Starr, Zachary Cohen, Ryan Browne, Alex Marquardt and Nicole Gaouette as defendants, in addition to the network itself. It claims CNN “deliberately or recklessly conveyed a false message” to sensationalize the “news” and humiliate Patel.

    To understand, you need to know about Kash. He was a prosecutor in Manhattan for some years so that’s the Big Leagues, then we worked with Devin Nunes uncovering all the bullshit about Crossfire Hurricane. If you’ve read Nunes’ accounts and others, you know the man is a Cape Buffalo. Quiet and utterly deadly.

    He doesn’t want the money. He wants discovery. The man has a plan.

    Trouble understanding?

    1) Electors are selected by the campaigns/parties early in the year.

    2) Each candidate has their own slate.

    3) When you voted on 11/3 for POTUS, you voted 4 that candidate’s Elector slate.

    4) The winner of the state PV [popular vote] wins the slate.

    5) Since we have a contested election in certain states, the Trump Campaign, along with certain state officials, are going to have the Trump slate of electors cast their ballots – at least in NV – for Trump as if they were already certified.

    6) Professor Eastman suggested this.

    7) This is what Democrats did in Hawaii during Election 1960. It is actually a Dem strategy.

    8) The idea is to avoid having the Trump electors miss the vote on Dec. 14

    9) Then, the Trump team have until at least 1/6 to have their electors certified, retroactively, by the SLs.

    10) This is what DEMOCRATS did in 1960 when the UNCERTIFIED Kennedy Electors, who voted in mid-Dec, where finally certified by January and VP Nixon counted them.

    11) It essentially buys time and keeps the election very much on.

    12) It also adds pressure to SLs 2 convene.

    Pray.

    PS Some people are mentioning the “faithless electors” laws. This is COMPLETELY irrelevant.

    Both SLATES – Biden’s and Trump’s – are voting.

    Biden’s vote for Joe and Trump’s for Donald.

    A faithless elector is someone who votes for someone other than their pledged candidate.

    Thread: In the 1960 presidential election in Hawaii between Kennedy and Nixon, the governor issued a certificate to the Republican slate of electors while there was an ongoing controversy about the vote count.

    2) However, the Democratic electors also met and cast their votes for Kennedy. That’s right, the Democratic electors ALSO MET and CAST THEIR VOTES.

    3) The recount revealed that Kennedy had in fact won, but electors for Nixon had already been certified.

    4) The 1st set of Nixon electors sent a certificate, the Democratic electors also sent a certificate (without certification) for Kennedy, and the governor of Hawaii sent a certificate for Kennedy. The third certificate by the governor was sent no earlier than Dec. 30

    2/ First question is why can electors be certified on December 30th but not January 1st?

    I will get back to the significance of January 1st later but for now just know that team Trump only sees January 6 as the date of significance and quotes the late RBG in their statement.

    3/ The other interesting point illustrated in that thread by KB is that it was Nixon as VP that decided the December 30th slate was the true slate. Indicating that the power to decide which are the valid electors is in Pence’s hands. Then from there the Congress can object.

    4/ Why do I point to Jan 1 as a date of significance? Because if eligible electors can be certified on Jan 1 it solves for one of the biggest hurdle to the state legislature solution which is that most are out of session and disbanded because their legislative year has expired.

    5/ As a result they can’t easily meet to vote a separate Trump slate unless their Governor calls a special session which D Governors won’t and R Governors have refused.

    But in most states the new legislative year begins Jan 1 and the new legislature is sworn in.

    6/ A lot can happen between today and January 1st that could motivate these legislatures to act. Will they? We will find out. Could they? Absolutely.

    I just wanted to highlight that the timeline isn’t exactly what we have been led to believe.

    7/ It would be a sweet irony if the stolen Kennedy election of 1960 became the precedent to block the stollen election of 2020.

    The Constitution is, at its heart, a contract. If the terms of it are subject to “interpretation” at the whim of whoever happens to be in office at the moment, it’s utterly meaningless.

    Well the living constitution managed quite happily to adapt the 2nd amendment to meaning the right to bear arms went from muskets where if you were good you could fire six shots a minute if you were good at it to modern day semi-automatic weapons where you can fire six shots in six seconds.

    Some aspects of the constitution are stuck in the past.

    Suppose your city has a law that requires dogs to be registered. You don’t own any dogs, but you have a cat.

    One day, an animal control officer knocks on your door and tells you that you’re being cited for failing to register your cat.

    “There’s no law requiring cats to be registered,” you say.

    “Oh, but we interpreted the term ‘dog’ in the law to mean ‘pets,’ so you’re now in violation. Here’s your citation.”

    Nope. The term “arms” is a broad category, encompassing pretty much any sort of weapons. Swords and bows are “arms,” too. If man-portable energy weapons are ever developed, it will include those, as well.

    The language of the Constitution was deliberately broad so that it doesn’t have to be changed every time something new is invented.

    This isn’t the EU, where they included specifications on the size and shape of bananas in their constitution.

    I see your point. But correct me if I am wrong but the electoral college members were originally selected by the individual state’s legislature. Not by a vote of the people of the state.

    Texas law is quite clear. It is a living document. Currently if you live on a property less than two acres you are allowed up to four dogs. Also you are allowed up to four cats. But the total must not be more than six dogs and cats combined unless there are dogs or cats under the age of six months.

    Also, here in Harris county you need a licence to own a dog or a cat.

    The laws and rules change with time.

    Nobody said they shouldn’t. I think you missed my point, though.

    I’m pretty sure that the laws regarding what pets have to be registered in Harris County are actually written down, and were passed by some legislative body (the county commission, I imagine).

    That’s the way it’s supposed to work, not by having some bureaucrat decide that it should change because they said so.

    The “broker water pipe stops count” has been debunked. It was a “water leak” — an overflowing toilet — not a “broken pipe”. It was found at 6:07 AM when they were opening up the Counting Room on Nov. 3. IT WAS REPORTED by Atlanta Journal Constitution at 7:00 PM.

    ** I used to work with Felons. A favorite prison trick of one was to disrupt an environment by flushing a whole roll of toilet paper down a toilet. Anything to gum it up.

    And in an actual productive work environment, the contents of the room would be picked up and moved to a dry room. Then damage assessed. I’ve done that several times over the years.

    Install a salad bar instead of a burrito factory at the counting area and this stuff won’t happen.

    I got the impression from Levin that his wife is working in AZ or CA with the Trump effort. Not on the actual teams but working unpaid in some type of legal capacity.

    Another rumor was that the GOP raised a lot of anti fraud money but isn’t picking up any expenses for these free lawyers.

    Rudy and Jenna are being paid by the RNC. Sidney and Lin are on their own.

    Interestingly there was a 50:50 split amongst Chinese students in NZ with one half supporting the CCP and the other half saying that did not. and actively saying that they supported Trump. Suddenly that metric has shifted to 80 % supporting a Biden Presidency. No measure was taken about who were still supporting the CCP.

    Even Churches and chinese christian group had the 50:50 split which was enlightening.

    From what you posted it seems like if a legislature thinks they were cheated in an election then as the most direct representatives of the voters they can create two slates of electors before the elector selection deadline. Pence gets to choose which is used.

    The most likely outcome is that the election is completed by the House with one vote per state.

    I’m not positive all (R) state legislatures would vote Trump. And the (R) govs like Kemp in Georgia seem iffy. The (D)’s will already be applying pressure to Kemp etc. The Republicans still have a lot of the old elite who still don’t understand how and why Trump became president.

    President Trump went to North Korea and had his picture taken with Kim. It just means legal influence was being worked on by both sides. Doesn’t mean President Trump is Chinese or North Korean.

    As news breaks about what looks to be a pretty large-scale hack, I have the utmost confidence in the @CISAgov team and other Federal partners. I’m sorry I’m not there with them, but they know how to do this. This thing is still early, I suspect. Let’s let the pros work it.

    Also, hacks of this type take exceptional tradecraft and time. On the 1st, if this is a supply chain attack using trusted relationships, really hard to stop. On the 2nd, I suspect this has been underway for many months. Need good detections to find victims and determine scope.

    If you’re a SolarWinds customer & use the below product, assume compromise and immediately activate your incident response team. Odds are you’re not affected, as this may be a resource intensive hack. Focus on your Crown Jewels. You can manage this.

    I’ve had a chance to read the analysis of the trojan software by FIREEYE, the private security firm. I don’t understand all of it because I’ve never developed network software. But it seems to me it is quite capable of altering data in a target (see the JOBS stuff)

    In Microsoft lingo a Trusted Relationship is the security relationship between two separate Domain installations. Where a domain is a companies Microsoft install with the physicals servers and an overlay of security objects.

    Like a bridge built between two countries.

    If one domain trusts another then can grant Read, Write, and Admin rights to user accounts in the other domain.

    If real life work Michigan might try and grant Dominion and the NYT only read rights to their election data via creating a trust relationship between the three organizations Microsoft installs. But in practice people are so unorganized with data structure that read writes seldom work in under budgeted orgs. They then default to admin rights for all objects in the foreign domain for a time period. That essentially gives admins of both systems access to all of everything. An admin in the weaker system could add Joe Biden account to his admin group granting Joe Biden complete access to Michigan’s voter data. It’s an open door to hacking. Hacking that doesn’t have an intrusion audit log.

    When I was penetration testing with major vendors years ago their software wouldn’t check for these types of errors. They annotated key card access. Physical access to the machines. And a lot of common script kiddie stuff. But never the underlying NTFS structure Microsoft uses. One could set a whole server to the group Everyone has Admin rights and the pen testing would never check. Brought it up a few times and was told not to bother. Outside of scope.

    I also routinely granted admin rights to vendors over one time modem connections to fix installation issues. Where a company like Dominion would become part of our admin network and given the keys to fix what ever they want. Stuff we didn’t understand.

    It comes down to can you trust the employee. Krebs can’t be trusted.

    If it’s the same Fireye then that was the software I used for pen testing a decade ago. They would be experts.

    Question maybe on the customer base for Solarwinds Orion software. All those location would be compromised. The hack does look really smart.

    It allows the trojan to set registry entries if it is launched within an admin process. (Which updates to software usually need)

    There is also an HTTP PUT process which is a vast security hole anywhere the PUT verb is not set to deny access. I can’t remember which one writes to disk. But HTTP needs to be restricted to read only. It was a common issue with third party devs where they create programs to allow HTTP write commands and our system shut those type of commands out of the operating system.

    Attack targets would come from the C2 server. And would be discoverable by the trojan doing a search of the file system, applying a dictionary of common installation configurations, or via an employee(CCP?) who was social engineered to email someone the project data and security architecture plans.

    Huge mess. It happened to me once. Hacked. And internet search revealed the hack came from China. And the Chinese hacker was on top of it. He knew we were hacked about two weeks before we did. He collected info and also uploaded content. We had to shut down a large portion of our firewall to everyone, try and recover, fail. Then just deleted the servers infected and restored them from backup.

    The CCP here is looking for Edward Snowden types of intrusion. Give the employee a custom USB to inject into the network. If you were to examine your company firewall logs you would probably see a constant flow of Chinese hacks against the company. A custom USB by an employee skips most firewalls. Fireye produces a report that shows the most popular hackers.

    A lot of times these hacks are overblown and the company is given a heads up to patch their system before any press is released.

    The Orion software is a swiss army knife for computer network health monitoring. It sends alerts to admins when something is wrong. The hack is capable of turning the alert off. All your eggs are in one basket.

    In the old days we wouldn’t do this. We would have separate systems not connected. But complexity of the cloud and business needs probably dictate that a large company has to have Orion software or something like it.

    The inventor of the ubiquitous QR code claims that widespread election fraud occurred and it can easily be proven through a simply scanning system.

    IT expert Jovan Hutton Pulitzer, who patented the QR scanning platform that’s on 12 billion devices, explained that his technology can easily scan through all the physical mail-in ballots to look for inconsistencies and forgeries.

    “When I started looking at ballots… I realized that everybody was speaking geek…It’s a real simple fact to prove that there was massive fraud in this election,” Pulitzer said.

    “We can take the physical ballot, the image scan of the ballot in the machine, the CVR file in the machine, and I can even take a shredded bag of ballots and do what we do.”

    Pulitzer then explained how legitimate mail-in ballots can be singled out from fraudulent ones by scanning for “kinematic artifacts” – the folds of a mailed ballot.

    “Technically, when these ballots get folded, everywhere there’s printing on that page, it creates a kinematic artifact. So the bottom line is, how can it be a mail-in ballot if it has no signs of being mailed?”

    Pulitzer also reminded that every ballot is duplicated under law and cannot be destroyed for 22 months after the election.

    “I want everybody to understand these physical ballots from the election, when they go into the machine, it basically makes a duplicate copy. That’s your property as an American citizen. We own it for 22 months after the election,” he continued.

    “And so when these courts started saying, well you can’t look at it, I realized it was all technical smoke and mirrors, to fool judges, to fool lawyers, to say oh we can’t really do it. “

    That is a lie. Orion is not a ‘package’ it is the KERNEL. That’s like saying you have a Unix/Linux system but you didn’t bother with the kernel. It’s the freaking mothership. Everything thing else is a plug-in to ORION.

    Newly declassified handwritten notes from former CIA Director John Brennan show that the U.S. intelligence community knew in 2016 that Russian intelligence was actively monitoring, and potentially injecting disinformation into, Clinton’s anti-Trump collusion narrative. The intelligence concerning Russia’s knowledge of Clinton’s campaign plans was so concerning to Brennan and other national security officials that they personally informed Obama of the matter in the Oval Office in the summer of 2016. The handwritten notes from Brennan were declassified by Director of National Intelligence (DNI) John Ratcliffe and provided to Congress on Tuesday afternoon.

    According to the declassified notes, Brennan and the U.S. intelligence community knew months prior to the 2016 election that the collusion smear was the result of a campaign operation hatched by the campaign of Democratic presidential candidate Hillary Clinton.

    I expect Donald Trump to announce his candidacy for the 2024 election moments after he leaves office if the fraud challenges fail and Biden is installed as an illegitimate president. Now, the precedent has been set that candidates for POTUS cannot be prosecuted as demonstrated by both Hillary and Biden.

    I’m not sure Fineswine is leaving the Senate. She’s giving up some committee assignments but they will carry her out of the Senate. She’s a reliable vote.

    Sentencing enhancements are the opposite of mitigating factors, basically. In NM, we have possible enhancements for use of a firearm, hate crimes, elderly victims, and repeat offender.
