NEWARK, N.J. — A former New Jersey train conductor fired two days after publicly burning pages from the Koran on Sept. 11 is expected to file a lawsuit Friday seeking reinstatement and monetary damages.

In its suit, the American Civil Liberties Union claims Derek Fenton’s constitutional right to free expression was violated by the dismissal. The suit seeks his reinstatement as well as compensatory and punitive damages.

Fenton burned part of the Koran to protest plans to build an Islamic center several blocks from the World Trade Center site. Police ushered him from the scene but he was not arrested.

NJ Transit said it fired him for violating its code of ethics.

Fenton “has the right to engage as a citizen in expressive activity about matters of public interest, including matters related to the proposed construction of an Islamic community center near Ground Zero,” the lawsuit alleges. “When he burned pages of the Koran on September 11, 2010, as a protest against the center, Fenton was exercising that right.”

NJ Transit’s code of ethics requires employees to give notice to an ethics liaison officer before participating in political activities. An employee can then participate in political activities so long as state or federal law or agency rules don’t explicitly prohibit them and “the activity doesn’t conflict with the employee’s official duties.”

It’s not known if Fenton gave notice of his plans. An NJ Transit spokeswoman said Thursday the agency wouldn’t comment on pending litigation.

Frank Corrado, an ACLU attorney handling the case, said the First Amendment doesn’t protect employees of private companies but it applies in Fenton’s case because NJ Transit is a quasi-public company created by state statute.

Flying pigs

Maybe this is a “flying pig moment” in that the ACLU is finally helping to protect freedom of speech for the counterjihad, at least in this one instance. Up to now, the ACLU has rarely been on the side of the angels.

The take-home lesson

A business or organization that is supported by our tax dollars does not get to violate the US Constitution. It does not get to muzzle employees and contractors who wish to engage in Constitutionally-protected political speech on their own time. If their “code of ethics” infringes, then it must be updated to uphold the US Constitution and any applicable State Constitution. If the organization finds that too problematic, then it is time to detach it from the government teat.

Of course, that goes for NPR, PBS, CPB, NEA, and NEH as well. It’s up to us to get our elected Senators and Representatives to take immediate, effective steps to enforce that.

Tariq Ramadan’s American tour

Tariq Ramadan, the famous silver-tongued Islamist (click on the first link), was granted a Visa exemption by Hillary Clinton, and so he will be off on his American tour. He was previously banned from the USA for donating money to Hamas. This is a man who stands for wife beating, is the grandson of Muslim Brotherhood founder Hassan al-Banna, and justifies jihad on Israel…but is considered a “moderate Salafi Islamist.” (whatever that means)

So first off will be a speaking engagement, co-sponsored by the ACLU (of course), at Cooper Union, the school which previously had that “famous luminary,” Hugo Chavez, come and speak. I guess Tariq Ramadan is in good company!

Next up, Tariq Ramadan will be speaking at the annual banquet of the unindicted co-conspirator, CAIR-Chicago, on April 10th.

And after that, on April 11, Tariq Ramadan will be speaking in the Detroit area, and address Muslim fest.

The coup de grace, so to speak, is that Tariq Ramadan will be speaking at the Ronald Reagan Building Ampitheater in D.C., apparently co-organized by our friends, the “United States Institute of Peace,” on April 28th. Go see the “wonderful” line up of Islamists and apologists set to speak at the Ronald Reagan theater, at a full-day event, titled: “U.S. Relations with Muslim World: One Year After Cairo.”

This is the symbol for the event: the U.S. flag shaped as a crescent, with a minaret covering Europe.

Please note that John Kerry, fresh off his “engagement” with Assad, was invited to be a speaker at this event, which features Tariq Ramadan (Islamist), and the U.S. flag as a crescent. And also please note that the U.S. Institute of “Peace” is a “bipartisan” Congressional organization that was behind the Iraq Study Group (i.e., sell Israel down the river report), and published John Limbert’s (who is on the board of an Iranian lobby group, the National Iranian American Council) articles.

It is clear now, that with his Visa waiver, Ramadan is going on a cross-country tour.

A source told me that John Esposito, in his talk at Northwestern University in Chicago, mentioned that Tariq Ramadan will stay for a long time in the USA.

That’s right, this Islamist gets the red carpet treatment, and forums to air his Islamist propaganda, courtesy of Hillary Clinton and the Obama administration. The ACLU (which I thought stood for civil liberties), is co-sponsoring this talk at one of our elite institutions. That’s right – more evidence of the Leftist/Islamist convergence, yet again. The U.S. Institute of “Peace” is co-sponsoring an event at the Ronald Reagan Theater. I am surprised J-Street did not co-sponsor this event!

It is enough to make one cry. But these are the times we live in. Blogmocracy netizens might be interested in attending any of the upcoming Ramadan talks, to either document what is being said, or to protest.

ACLU sues Jihadi School in Minnesota

This is a flying pig moment. The ACLU is suing a Muslim school for promoting the Islamic religion!

ACLU to sue Twin Cities charter school that caters to Muslims

The American Civil Liberties Union of Minnesota filed suit Wednesday against a publicly funded charter school alleging that it is promoting the Muslim religion and is leasing school space from a religious organization without following state law.

The suit was filed in U.S. District Court in Minneapolis against Tarek ibn Ziyad Academy, known as TIZA, and the Minnesota Department of Education, which the ACLU says is at fault for failing to uncover and stop the alleged transgressions. The suit names the department and Alice Seagren, the state education commissioner, as co-defendants.

This is great! For too long Muslims have been getting away with imposing their ways on the majority population. They play victim while imposing their Arabic values on the rest of us. It’s about time the ACLU stops going after Christian and goes after the real target. The Political Islamic Movement which is allied with the Left.
